Lobby Letter to Health Food Evaluation Center of CFDA on the Impact of Marking Allergens in the Warning of Labels

The Cosmetics Working Group submitted a lobby letter on the Impact of Marking Allergens in the Warning of Labels to the Evaluation Centre. Member companies faced new requirements from the experts on the products labels, which are new requirement and without transitional period given. It will have huge impact to the industry, especially the EU brands. In addition to a lobby letter to explain that there has no urgency or necessity of have such a new requirement, we also asked for a meeting to exchange with evaluation center face to face after the National Day holiday.

Comments on the Second Call for Comments Draft on the Cosmetics Supervision and Administration Regulations (CSAR) By Ministry of Justice (MOJ)

Cosmetics Working Group submitted the comments on the Second Call for Comments Draft on CSAR by MOJ on 31 Aug. For this round of call for comments, MOJ only chose some associations and organizations to collect written comments, and EUCCC was one of the selected ones. It was a very good opportunity for members to raise concerns and make comments directly. Our comments was mainly about products management, ingredients management, equal treatment to imported products and information disclosure.

Seminar with CFDA Registration Department and NIFDC

Representatives from Hair Dye project team of EUCCC Cosmetics Working Group visited NIFDC, to discuss the next step of the project on “ingredients in/out mechanism in the positive/negative list of Safety and Technical Standards of Cosmetics” with CNDA officials and NIFDC experts. The industry was informed that there would be an standard committee meeting organized in September/October to review the hair dye application from the project team.

Meeting with China National Drug Administration

Representatives from EUCCC Cosmetics Working Group had a meeting with officials from CNDA, Hainan FDA, and representatives from China Deputy Free Group and Hainan Duty Free Co. Ltd, to discuss the Shanghai Pudong Imported Nonspecial Cosmetics Notification Pilot policy, its implementation and impact to Hainan island duty-free shops.The Pudong notification is not valid when importing products by Hainan island duty-free shops, which prevents companies participating in the pilot from taking full advantage of the benefits.
The industry suggested the notification certificate be recognized and applied to customs declarations in all ports, including Hainan. Though CNDA did not accept the industry’s suggestion at the meeting, they promised to consider it and provide a solution to the industry afterwards. All sides thought that it was a very good discussion.

Advocacy Letter to China National Drug Administration on Recommendation on the Management Adjustment to the Pudong Pilot Programme

The European Chamber’s Cosmetics working groups submitted an advocacy letter to CNDA tore commend, based on the Pudong Pilot Program and under the guidance of the CNDA, Shanghai FDA, and by the implementation of Pudong Market Supervision Administration, before the program ends in 2018, a product safety evaluation report be used to replace animal testing in the materials submitted to notify an imported non-functional cosmetic product. This evaluative form can only be valid on the condition that the ‘responsible person’ (a term denoting corporate responsibility) will undertake all responsible precautionary measures to guarantee a product is safe and of good quality, to ensure a competent quality management system is established and to make sure onsite inspections of overseas manufacturing is doable.
