Food Safety Law Update

 

Dear F&B WG Member,

The Food Safety Law draft is under its 4th reading at the National People's Congress (NPC) Standing Committee meeting from 25th to 28th Feb. There are the following amendments in the most recent draft, according to the official website of NPC.

 

1/ To establish a central food safety coordination mechanism;

Most possibly the new law would state that the State Council sets up a Food Safety Committee and assign its mission accordingly. (This might lead to the question what exactly would be the to-be-defined functions & responsibilities and how would be the role of MOH, who was previously assigned as the overall coordination Ministry.)

 

2/ To apply more strict supervision and inspection to health food / functional food / dietary supplement;

 

3/ To precise the responsibilities of Ministry of Agriculture and to set up record system on production of Agricultural products;

 

4/ To strengthen the supervision and management of advertisement of food & beverage industry with legal liability;

 

5/ To precise the priority of civil compensation

According to Legislative Commission of NPC, the current version of draft is ready to be approved. Chances are it will be promulgated at the meeting of this week. More details are expected to be available at the Press Conference on 28th Feb. following the meeting. The EUCCC will continue to closely monitor the development.
