关于《中华人民共和国广告法(修订草案)》的说明
一、修订的必要性
《中华人民共和国广告法》(以下称现行广告法)自1995年2月1日施行以来,在规范广告活动、促进广告业健康发展和保护消费者权益方面,发挥了重要作用。近年来,随着我国广告业迅速发展和互联网广泛应用,广告发布的媒介和形式发生了较大变化,现行广告法的有关规定过于原则,约束力不强,对一些新问题、新情况缺乏规范,已不能完全适应广告业发展的客观需要:一是广告准则内容不够完备,针对性不强,药品、医疗器械、农药、兽药、烟草等广告准则内容较为单薄,保健食品、医疗、教育、培训、房地产等广告缺乏专门规定。二是广告活动规范不够明晰,广告主、广告经营者、广告发布者和广告荐证者的义务与责任缺乏清晰界定,对未成年人权益保护不够,对网络广告的监管需要加强。三是虚假广告的认定标准亟待明确,有效惩治虚假广告的法律依据还不完善。四是法律责任的针对性和操作性不强,惩处力度不够,难以有效遏制广告违法行为。
