Seminar on Advertising Law Update

On August 18th, European Chamber Shanghai invited Mr. Ying Jun, the Chief of the Division of Advertising Supervision and Administration of Shanghai Administration of Industry and Commerce (AIC) to speak about the recent amendment of the Advertising Law. He introduced the background of the amendment and the major changes in the new law by comparing it with the old version. Through case illustration, he also explained important implications it may have on industries.

According to Mr. Ying, regulations on products that may affect public health such as pharmaceuticals, health food, breast-milk substitutes, additives, tobacco, alcoholic beverages, etc. have been tightened. Some areas requiring special attention are tobacco products advertising, juvenile-related advertising and internet advertising. The new law also clarifies the subject of responsibilities of deceptive advertisement and for the first time defines the responsibilities of advertisement endorsers.

After the presentation, Mr. Ying gave further explanations upon member companies' inquiries.
