The 10th Year China Anti-monopoly Legislation Review & Anticipation Conference

On 4th July, the 10th Year China Anti-monopoly Legislation Review & Anticipation Conference was held in Kerry Hotel Beijing. This Conference was sponsored by the Expert Commission on Competition Policy & Legislation from the China Society for World Trade Organization Studies (referred as the Competition Commission below) and co-hosted by Beijing JT & N law firm.

80 participants in total including people from research institutes, colleges and universities, on-site and business sector experts attended this event. Among the most prominent guests there were Honor Consultants of Competition Commission Xiaosong Yu and Qiong Zhang, Vice Chair of China Society for WTO Peng Chen, Director of the Competition Commission Ming Shang; Vice Director of the Competition Commission Huang Yong; Section Chief of the NDRC Price Supervision & Anti-monopoly Bureau Huowang Wang; Researcher of the MOFCOM Anti-monopoly Bureau Junfeng Cai: Section Chief of SAIC Anti-monopoly and Anti-unfair Competition Enforcement Bureau Kun Zhang; Senior Consultant of the Competition Commission Hanhong Wu; Experts at the Competition Commission Yudong Qi, Jiangping Xiao, Jin Sun, Shilin Wei, and Junlin Wang; Partners of JT & N law firm Yu Tian, Chen Yang, and Guodong Zhang; and Vice Secretary-general of Competition Commission Jinsong Wang, Tie Hu, and Huan Qi.

The conference was divided into two parts: the first part was the keynote speech, and the second part was a discussion session.

The first part of the conference was hosted by the Director of Competition Commission, Shangming Ren. Opening speeches were given by Honor Consultants of the Competition Commission, Xiaosong Yu and Qiong Zhang, the Vice Chair of China Society for WTO, Peng Chen, and the co-host of this conference, Yu Tian from Beijing JT & N law firm, respectively. The Vice Director of the Competition Commission, Huang Yong, and the Senior Consultant of the Competition Commission, Hanhong Wu, both delivered the keynote speeches. After that, the Section Chief of NDRC Price Supervision & Anti-monopoly Bureau, Huowang Wang, Researcher of MOFCOM Anti-monopoly Bureau Junfeng Cai, and the Section Chief of SAIC Anti-monopoly and Anti-unfair Competition Enforcement Bureau, Kun Zhang, gave a detailed introduction of legislation in their own law-enforcement agencies, and expressed their anticipation for future law-enforcement work. Partner lawyer Guodong Zhang from Beijing JT& N law firm talked about the review and anticipation of the 10th year China Anti-monopoly legislation from a pragmatic perspective.

The second part was hosted by Professor Jieming Sheng from Peking University. Haitao Jiao, who gained a post-doctoral degree from the China University of Political Science and Law, delivered a keynote speech on “The Institutionalization of Competition Policy and Amendment of the Anti-monopoly Law” in lieu of the Vice Director of Competition Commission Jianzhong Shi. Experts of the Competition Commission Yudong Qi, Jiangping Xiao, Jin Sun, Shilin Wei, and Junlin Wang, CRRC representative Xiaoyi Chen, and Maersk representative Yingtong Shi together with other experts, individuals from the field, and representatives from the business sector – participated in the discussion. Everyone went through a deep discussion on their experiences of China Anti-monopoly legislation and law enforcement and how to better improve Chinese Anti-monopoly legislation in the future from distinct perspectives. Views and opinions from relevant companies made the discussion even more exciting. Every participant enjoyed the lively discussion, which was only interrupted due to time limitations.

In the end, the Director of the Competition Commission Shangming Ren made a closing speech on this conference. He stated in this closing speech that the outcome of the conference had been very positive. The result from the discussion will encourage the law enforcement and dissemination of China Anti-monopoly legislation as well as the amendment on China Anti-monopoly legislation. Competition Commission will hold similar activities in the future to better take advantages of the platform of Competition Commission, and develop it into a think tank of China Competition Policy.
