European Chamber Representative Presents the Chamber's Stance on the Implementation Rules of the Foreign Investment Law

On 23rd July, Helei Fu, Government Affairs Director of the European Chamber Shanghai Chapter, took part in a discussion on the implementation rules of the Foreign Investment Law (FIL), and what Shanghai can do to improve the local business environment. The meeting was organised by the Shanghai Commission of Commerce (SCOFCOM) and chaired by Yang Chao, deputy director general of the SCOFCOM. Representatives of foreign business associations were invited to provide their feedbacks.

Ms Fu reiterated the Chamber's stance on the FIL that, while some feedback provided by the Chamber was given a degree of consideration, two major concerns—the legal distinction between domestic and foreign enterprises and a ‘retaliatory’ clause (Article 40)—remained in the final draft. The implementation rules should publish the leading ministries responsible for the individual implementation rule, as well as a clear work plan and timeline for implementation of the legislation, so that the business community can plan ahead.
