Lobby Letter to the State Administration for Market Regulation on Base Powder Labeling Requirement

On August 26th, the Paediatric Nutrition Desk submitted a lobby letter to the State Administration for Market Regulation (SAMR) on Article 42 in the consultation draft of Administrative Measures of Food Labeling. The Article includes a new requirement to label the base powder used in infant formula product. The lobby letter emphasized industry's analysis and concerns on this requirement and also explicated the recommendation to remove this requirement from the Administrative Measures.

The foresaid requirement has no legal basis and is inconsistent with current labeling regulations. Meanwhile, it may lead to consumer's misunderstanding on the use of base powder in infant formula and industry unfair competition. Therefore, the Paediatric Nutrition Desk recommended the SAMR to remove this requirement from the Administrative Measures.
