In today's technology-rich environment, companies increasingly get involved in technology licensing and recognize the value of data as a business asset that should be protected and can be exploited through licensing to other parties for more synergy.

Companies therefore can encounter a range of agreements that implicate the protection and treatment of technology, data and related intellectual property (IP) rights. Where one party is seeking to exploit a software, a data feed or has developed a database it wishes to license, data and IP issues may be the specific focus of a transaction. However, those issues also arise as an ancillary consideration in other licenses and commercial transactions, e.g. technology services arrangements or as capital contribution for joint ventures.

As one of the basic schemes established by the Cybersecurity Law, the Classified Cybersecurity Protection Scheme (CCPS) will go beyond the protection of mere information systems required by the 2007 Classified Information Security System, to new areas such as cloud computing, mobile Internet, Internet of Things and industrial control, and will cover all networks in China apart from domestic and private ones.
