The newly amended regulations of Shanghai Municipality on the protection of consumers' rights and interests came into effect from August 1st, 2022. This is the second time that Shanghai has revised the regulation after eight years, adding 24 new articles and amending 63 articles. This revision includes new provisions on the obligations of operators for various business activities, such as webcast, blind box sales and cross-border e-commerce, and on the handling of consumer personal information.

The European Chamber Shanghai Chapter is excited to commemorate the 6th consecutive year of our Sustainable Business Awards (SBA). The 2022 edition will continue to put sustainability awareness at the forefront of its focus, recognizing companies who push for sustainable economic growth, environmental care and social welfare. On 15th September 2022, the European Chamber will host a ceremony in Shanghai to announce the winners of this year's edition.

For this introduction session, we would like to welcome all interested applicants for our SBA, members and non-members of the Chamber, on Tuesday, 14th June at 2:30pm (GMT+8), to the online Zoom webinar, joined by our SBA knowledge partner, SynTao. This session will detail the 2022 SBA, including award categories, time schedule, evaluation process, methodology, what makes a successful case, as well as a Q&A session to answer any further questions. Those who are interested in applying to the 2022 SBA will find this session beneficial for understanding all new developments involved. Ms Tiantian Qi from European Chamber Shanghai will introduce the general idea of the 2022 SBA and the evaluation process. Mr Jilai Peng from SynTao will introduce all award categories, evaluation methodology and observations.

To successfully halt counterfeiting in China, it is essential for one to prove that his or her IPR have been infringed, backing by a significant volume of evidence. In Chinese Court the burden of proof lies with the plaintiff. As one proves his ownership via IPR certificates he must also prove the infringement via physical evidence including contracts, photographs of infringing products and proof of sale which have been validated by a notary public.

As a follow-up event of the meeting on the Trademark Law, this meeting aims to explain why the evidence of IPR infringement is important, what can be used and how to effectively secure the evidence needed. The European Chamber is pleased to invite Mr. Lionel Yan and Mr. Benjamin Miles from Blackpeak to share their best practice on evidence notarisation.

On 1st November 2019, China's Ministry of Justice (MOJ) released a draft version of Regulation on the Implementation of Foreign Investment Law. The Draft provides much-needed clarity on certain challenging issues in the Foreign Investment Law (FIL), such as how to reconcile the corporate structure of foreign investment enterprises during the transition period, while leaving certain areas for further clarification. In addition, further ramp up efforts to protection on IP rights, the Draft provides that China establishes the punitive compensation system for intellectual property infringement.

Joint Working Group Meeting: China’s Social Credit System – What to expect?

Chinese government authorities have recently issued a series of policies and draft amendments to push forward the establishment of the Social Credit System (SCS). Foreign enterprises are particularly concerned at how the SCS could affect the business operation of their Chinese subsidiaries.

As the Social Credit System will be largely in place by the end of 2020, SCS is no longer just a vision. With the window of opportunity rapidly closing for companies to prepare for these regulatory ratings, companies need to stay alert for the upcoming the SCS and expect that heavy non-compliance will immediately lead to a listing as a distrusted entity, followed by costly sanctions.
