我国《数据安全法》规定,国家建立数据分类分级保护制度,根据数据在经济社会发展中的重要程度,以及一旦遭到篡改、破坏、泄露或者非法获取、非法利用,对国家安全、公共利益或者个人、组织合法权益造成的危害程度,对数据实行分类分级保护。同时,有关部门应制定重要数据目录,加强对重要数据的保护。

随着相关工作持续推进,近期,数据安全与分类分级治理出现一系列新动向。例如,2024年3月19日,国务院办公厅印发《扎实推进高水平对外开放更大力度吸引和利用外资行动方案》,明确提出健全数据跨境流动规则,科学界定重要数据范围。3月20日,国家标准委批准发布推荐性国家标准GB/T 43697-2024 《数据安全技术 数据分类分级规则》以及作为规范性附录的《重要数据识别指南》,对企业的合规工作提出了进一步指引和要求。与此同时,部分行业、领域和地方在数据安全和分类分级治理方面,也出台了相关规定。

在这一背景下,中国欧盟商会有幸邀请国家工业信息安全发展研究中心科技委成员、产业促进所研究部主任杨晓伟博士和世辉律师事务所合伙人王新锐,就近期数据安全与分类分级治理相关工作和动态进行分享。

In Chinese Court the burden of proof lies with the plaintiff. As one proves his ownership via IPR certificates he must also prove the infringement via physical evidence including contracts, photographs of infringing products and proof of sale which have been validated by a notary public.

As a follow-up event of the meeting on the Trademark Law, this meeting aims to explain why the evidence of IPR infringement is important, what can be used and how to effectively secure the evidence needed. The European Chamber is pleased to invite Mr. Lionel Yan and Mr. Benjamin Miles from Blackpeak to share their best practice on evidence notarisation.

The Draft provides much-needed clarity on certain challenging issues in the Foreign Investment Law (FIL), such as how to reconcile the corporate structure of foreign investment enterprises during the transition period, while leaving certain areas for further clarification. In addition, further ramp up efforts to protection on IP rights, the Draft provides that China establishes the punitive compensation system for intellectual property infringement.
