In a much-anticipated announcement, the National People's Congress released for public consultation on 3rd July the second draft amendments to the Patent Law. Significant changes include the introduction of a Patent Linkage system and a Supplemental Protection Period. These issues have long been discussed but there had been no further information released since the Supplemental Protection Period had been included in the previous draft on 4th January 2019.

The draft amendments to the Patent Law are open for public opinion until 16th August 2020. If you would like to send in comments through the chamber, please kindly submit your comments to sthe@europeanchamber.com.cn by 7th August.

Tengda ((2019) SPC IP Civil No. 147), holding that the manufacturer’s making and selling of routers directly infringed a telecommunication method-of-use patent even though the manufacturer itself did not perform the patented method. This case is recognised the Chinese Akamai case.

The European Chamber is delighted to invite Mr. Steve SONG, Partner and Patent Attorney of Beijing DHH Law Firm, who represented the defendant in this landmark case to provide our members insights by studying the judgement of a few cases regarding multi-party patent infringement.
