The IPR Working Group is pleased to invite you to the meeting 2021-2022 chair elections, which is taking place on Friday, 5th March, 10:00am to 12:00pm (GMT+8:00, China time) at the European Chamber’s Shanghai and Beijing offices, as well as online via Zoom.

The first part of this meeting will consist of a sharing by Mr Reinout van Malenstein, Vice Chair of the IPR working group on the amended Copyright Law. On Nov. 11, 2020, the Standing Committee of the National People's Congress passed the latest revision of the Copyright Law, its third amendment. Effective January 1st, 2021, the amended Copyright Law introduces some significant wording changes as well as an increase in the penalties in case of infringement, which Reinout’s presentation will further explore.

The second part of this meeting will consist of the 2021-2022 chair elections. Candidates running for the elections will introduce themselves and their goals for the IPR Working Group over the following 12 months. Only IPR WG members who had their registration confirmed for this meeting will have the right to vote in person or online, with one vote per company. Online voting instructions will be sent via email to individual attendees prior to the meeting.

10月27日,上海市十五届人大常委会第二十六次会议表决通过了《上海市反不正当竞争条例》(以下简称“《条例》”)并将于明年1月1日施行。本次通过的《条例》将上位法修订后的相关规定以及实践中总结的诸多新业态及问题纳入其中,在《反不正当竞争法》的框架内做了很多细化,但其中仍有某些界定较为模糊,增加了企业面临监管的合规压力。

中国欧盟商会有幸请到上海市人大常委会法制工作委员会两位老师莅临商会为会员公司深度解读《上海反不正当竞争条例》的立法思路,并解答会员针对该《条例》的疑问与顾虑。现诚邀企业报名参加,本次讲座向中国欧盟商会会员免费开放。

After 12 years’ waiting, the 4th version of the Patent Law with an aim of further motivating innovations and improving the mechanism for cracking down patent infringements was finally passed on October 17, 2020. The amended Chinese patent law will take effect on June 1, 2021. Second Amendments introduced pharmaceutical patent-term extensions and established an early pharmaceutical patent-dispute resolution mechanism and patent linkage system that further protects the rights of patentees.

The European Chamber is delighted to invite Ms Mi LI, Principal at Rouse and the IP Consulting Director of Rouse China in Beijing to break down the changes and challenges, as well as outlooks ahead for our members in the pharmaceutical sector.

IPR Working Group Meeting: IP Protection in China’s Digital Economy

The global pandemic has further accelerated the digital transformation of businesses resulting in increased reliance on e-commerce platforms, boom in the AI-related industries and digitalisation of production and delivery processes. With digitalisation of businesses, consumption too has increasingly moved online. Intellectual property (IP) is crucial to digital economy as it drives innovation and provides SMEs with comparative advantage over competitors. While digital economy brings about new IP risks like online infringements, it also creates new solutions for IP protection such as the use of blockchain technologies or reliance on sophisticated notice and take-down systems on e-commerce platforms or even the use of internet courts speeding up IP enforcement procedures. To be successful in digital economy, SMEs should focus on protecting their IP by adopting a comprehensive IP strategy taking into account the needs of digital economy.
