为加强网络直播营销活动监管，保护消费者合法权益，促进直播营销新业态健康发展，2020年7月29日，市场监管总局发布了《关于加强网络直播营销活动监管的指导意见（征求意见稿）》。
网络直播营销带货是一种新兴的电商交易模式，对于网红直播带货法律性质的认识存在较大分歧。为了帮助企业更好地了解该指导意见、网络直播营销的监管趋势和对企业营销活动的影响，中国欧盟商会很荣幸地邀请到中国广告协会副秘书长赵践，分享网络直播营销活动的规范背景和对网络直播新业态的看法，并邀请到霍金路伟律所合伙人龚英姿，在广告法、电子商务法、反不正当竞争法、消费者权益保护法等法律的背景下解读《关于加强网络直播营销活动监管的指导意见（征求意见稿）》的主要条款以及对企业的影响。

In order to strengthen the supervision of live-streaming marketing activities, protect the legitimate rights and interests of consumers, and promote the healthy development of the new business form of live-streaming marketing, on 29th July 2020, the General Administration of Market Supervision issued the Guidance on Strengthening the Supervision of Live-streaming Marketing Activities (Draft for Comments).
Influencer live-streaming marketing is an emerging e-commerce mode. The legal definition of influencer live-streaming marketing is facing disagreements. In order to help enterprises better understand the Guidance, the regulatory trends of live-streaming marketing and the impact on corporate marketing activities, the European Union Chamber of Commerce in China is pleased to invite Zhao Jian, Deputy Secretary General of the China Advertising Association, to share the regulatory background of live-streaming marketing and views on the new business model of live-streaming marketing, and to invite Sherry Gong, Partner at Hogan Lovells, to interpret the key provisions of the Guidance on Strengthening the Supervision of Live-streaming Marketing Activities (Draft for Comments) in the context of the laws such as Advertising Law, E-comerce Law, Anti-unfair Competition Law, Consumer Rights Protection Law and the impact on enterprises.
