Dear Members,
The Human Resources Working Group is pleased to invite you to the meeting “Understanding Employment Disputes: 2021 Rules and Judicial Interpretations”, which is taking place on Wednesday, March 3rd, 16:00 to 18:00 (GMT+8:00, China time) at the European Chamber’s Shanghai office, as well as online via Zoom. At this meeting, we will also hold the 2021-2022 chair elections.
The first part of this meeting will consist of a sharing by Ralph Koppitz, Senior Advisor at Shanghai Linie Investment Consultancy Co., Ltd. (bio attached). Effective January 1st, 2021, China’s Supreme People’s Court annulled 116 interpretations and other documents, including four employment dispute regulations. At the same time, a new, consolidated employment dispute interpretation has come into force, which Ralph Koppitz’ presentation will explore.
At this meeting, Ralph Koppitz will break down the core content of the new SPC interpretation, namely:
· labor disputes involving foreigners
· post-contractual non-compete obligations
· overtime payment
· oral changes to labor contracts
· amicable termination and settlement agreements
· involvement of the trade union in terminations
· basic procedural aspects in labor disputes
The second part of this meeting will consist of the 2021-2022 chair elections and 2021 HR Position Paper (PP) discussion. Candidates running for the elections will introduce themselves and their goals for the Human Resources Working Group over the following 12 months. Only Human Resources WG members who had their registration confirmed for this meeting will have the right to vote in person or online, with one vote per company. Online voting instructions will be sent via email to individual attendees prior to the meeting.
Please kindly review the attached Key Recommendations from the 2020 HR PP before March 3rd and bring your feedback/input for this year’s PP to the meeting so that we can have a fruitful discussion together.

Working Group members interested in running for this year’s Chair elections, should take notice of the following:
Roles and Responsibilities
The Chairperson and Vice Chairs play a crucial role in driving the Working Group, including a leadership role in the drafting of the Position Paper, communicating key messages to Chinese and European government authorities and steering Working Group meetings. The desired characteristics of a Chair and Vice Chairs are a senior industry representative with relevant expertise and government contacts who has the time and willingness to support the Working Group. Previous participation in the Working Group is essential. Before applying for the position of Chair or Vice-chair, we recommend that you obtain approval from your company.
The maximum duration of Chairperson or Vice Chairperson of a Group is three consecutive years. Candidates are only eligible for Chair or Vice Chair positions if he/she is physically based in China. The Human Resources Working Group is going to elect one Chairperson and two Vice-Chairpersons (in Shanghai and South China Chapters).
The Chairs and Vice-Chairs should represent different sectors and issues, therefor we encourage employees across industries as well as candidates both of Regulatory Affairs and Government Affairs background to apply for elections. If you are interested in running for Chair of Vice Chair, please read the attached Starter Kit for Chairs and submit the following information to bborri@europeanchamber.com.cn before Monday, February 22nd, COB:

Speakers
Mr. Ralph Koppitz
Mr. Ralph Koppitz
Ralph studied law in Munich and Mandarin in Beijing. From 1997, he was based in China and is advising international companies regarding their China engagements. From 2002 to early 2020, he headed the Shanghai office of a major international law firm and the firm’s China employment group. 2021/2022, Ralph worked as assistant professor at Shanghai University for Political Science and Law. Since autumn 2022, he is based in Potsdam / Germany.
His main advisory focus is on corporates and joint ventures / NGOs, support in contract negotiations, employment and immigration related legal topics. This includes corporate sustainability due diligence. Since 2003, Shanghai Linie Investment Consultancy Co., Ltd. provides agency support for company set-ups, corporate housekeeping and all types of immigration titles (visa, work and residence permits, green cards for foreigners).
