[English Language] New Anti-Monopoly Law Developments and their Implications for Foreign Companies

A year ago, the National People’s Congress passed the very first amendment to China’s Anti-monopoly Law (“AML”), which took effect from 1st August 2022. The amended AML brings about important changes, including on key aspects of companies’ business operations such as distributor pricing. In March 2023, the State Administration for Market Regulation (“SAMR”) adopted four regulations to implement the amended AML. These implementing regulations came into force very recently, on 15 April 2023.
In addition, over the past few weeks and months, SAMR and its provincial offices have embarked on a series of new enforcement actions and issued new penalty decisions, in the life sciences, energy and other areas.
Noting this, the European Chamber is honoured to have Mr Adrian Emch, Vice Chair, Legal and Competition Working Group, and Partner of Hogan Lovells, as guest speaker to share his insights on the recent AML developments and their implications for foreign companies. Adrian heads the Hogan Lovells Asian antitrust practice. Adrian is an EU-qualified lawyer, with several years of private practice in Brussels and a short stint at the European Commission’s DG Competition. For the last 15 years, Adrian has been based in Beijing.
