Everyone knows: The competition and pressure in the Chinese market environment increases. Companies more frequently face the need to adjust their personnel and workforce to a changing demand and to cut jobs or to replace low performing employees with better talents.
Adjusting the workforce, cutting jobs and terminating employment contracts of low performing employees can be risky and many organizations are not sufficiently prepared, not experienced and simply don't know how to handle contract terminations.
That usually leads to a couple of risks, such as:
• Legal and financial risks related to employment contracts and labor law. These risks often amount to at least 3 months’ salary, often more.
• Business risks and risks of lost opportunities related to demotivated and frustrated employees
• Risks of unintended business critical employees as a side effect of contract terminations
• Risks associated with “extreme reactions” of employees, such as data protection, sabotage, health and safety of other employees and management
• Risks of strikes and rigid labor relations
These risks can be managed and often avoided, if the management and HR department are well prepared.
This seminar helps to identify strategies to mitigate risks associated with personnel capacity reductions and contract terminations and gives a full overview about the relevant aspects which have to be observed in these processes. The seminar will be conducted in an interactive and workshop style setting to ensure best learning effects for each participant.

Speakers
Dr. Iris Duchetsmann
Iris is a German lawyer working in China and partner of the international law firm Clyde & Co. She specialises in labour law, particularly aspects that involve cross-border employment and international HR management. She also provides advice on matters such as residency, tax and social security. Iris has extensive work experience in China, Asia and Germany. Before joining private practice she worked as an in-house lawyer in the HR department of a multinational, gaining insights into corporate processes. Her clients include international corporations, other enterprises and executives from various industry sectors, including automotive, energy, transportation, chemical, media, textile, consulting, etc. Iris is a native German speaker, fluent in English and has a good command of Mandarin Chinese. She is a frequent speaker and author on international and national labour law and HR topics. Iris has been elected as Vice Chair of the EUCCC HR Forum since 2010 and has been sitting as member of the EUCCC Shanghai Board since 2012.
Mr. Daniel Alexander Hein
Daniel Hein currently leads the Renewable Certification organisation of DNV GL Group in China. Daniel has been leading the Human Resource Management organization of Germanischer Lloyd in the region Asia/Pacific for 5 years and is located in Shanghai since January 2008. Prior to his roles in China he worked at the European HR service centre of Du Pont in Gijon, Spain and as business development manager in the solar industry in Germany. Furthermore he worked as management consultant for small and medium size organizations in Germany. Mr. Hein graduated at the University of Ravensburg and obtained an MBA in Human Resource Management and Consulting at Pforzheim University in the year 2007, in Germany. Mr. Hein was contributing writer to the books “Die besten Mitarbeiter finden und halten” (English translation: "How to attract and retain the best talents") and “Die TEMP Methode” (English translation: "The "TEMP method"), a management tool for entrepreneurial success". Mr. Hein has a passion for ethical leadership and to contribute to the sustainable development of organizations and individuals.
