At the meeting, Ms. Sun Lei, Senior Associate at Gide Loyrette Nouel will give a presentation on Case study: New Rules for Work-related Injury and Strategies for Handling Wrongful Termination Claims. On August 20, 2014, the Supreme People's Court issued the new judicial interpretation on work-related injury administrative lawsuits which has drawn heated discussion about work-related injury legal issues. The highlights of the new development of Chinese labour law on this topic can be explained through the study of several typical cases. In addition, Ms. Sun Lei will also share highlighted two case studies on labour law dispute from the Top ten China Labour Dispute Cases in the Year of 2013, which covers the issues of Implementation of Non-compete Agreement and Wrongful Termination of Employment. These two issues are also very often encountered by the HR managers of the FIEs in China and strategies should be carefully considered to tackle these issues.

Provision Background
On August 20, 2014, the Supreme People's Court held a press conference, where the Provisions Concerning Relevant Issues in Trial of Administrative Cases of Work-related Injury (the Provisions) was detailed about and 4 typical administrative cases regarding work-related injury were announced, drawing heated discussion about work-related injury. The Provision released by the Supreme People's Court is against all expectation. Besides major adjustment in existing identification measures of work-related injury, the subject and content of work-related injury identification are extended, the subsidy improved and the identification procedures reduced. This new subversive interpretation of the Regulations on Work-related Injury Insurance and the Labor Law will have huge impact on employer's attitude and actions towards employment and work-related injury identification.
