In early 2013 President Xi let it be known that his administration was not going to be business as usual. In a relatively short period of time, we have seen a series of investigations into different sectors – notably pharmaceuticals and medical devices, automotive and technology, energy and mining. High-profile investigations and trials have ensued, resulting in judgments with unprecedented fines and lengthy jail sentences. When asked if this is just another campaign which will soon abate, President Xi and others throughout the administration have consistently indicated this is the “new normal” (新常态) to which all companies operating in China will have to adapt.
Combined with the challenges of achieving growth in a slower economy and facing tougher local competition, 2016 is going to be another challenging year for companies operating and investing in China. The most successful companies will demonstrate two core characteristics. First, they will build long term sustainable compliance programs that are closely aligned with commercial “go to market” strategies and second, they will align risk management with government relations, moving from a relationship based government relations approach to an analytical approach, able to understand and assess the rapidly changing political and economic environment.
