In recent years, Chinese authorities have increased their enforcement of the Anti-Monopoly Law (AML) and the Anti-Unfair Competition Law (AUCL), resulting in extremely large fines for companies and, often, changes to long-standing business models. In this context of aggressive law enforcement, it is critical for multinational companies to closely monitor enforcement activities and be prepared for changes to the enforcement agencies' guidelines on the application of the Anti-Monopoly Law.
This session will address important proposed changes to the China's anti-trust laws governing protections for trademarks and trade secrets, as well as revisions that would alter the treatment of various common business practices.
The European Chamber is pleased to welcome Mr. Steve Harris, Partner in Winston & Strawn LLP’s Washington, D.C. and New York offices, Ms. Jingwen Zhu, Partner in Winston & Strawn’s Shanghai and Hong Kong offices and Mr. Kent D. Kedl, Senior Partner of Control Risks Asia Pacific to address potential concerns regarding certain elements of the proposed revisions to the AUCL, recently published by the Legislative Affairs Office of the State Council. These concerns include possible conflicts between the revised law and the Anti-Monopoly Law.
