On November 8th, 2016, France adopted a new anti-corruption law “Sapin 2”. Based on the new law, French companies (especially multinationals) will have to implement increasingly diligent measures to prevent, detect and sanction corruption.
France has in the past been criticized by regulators in other countries for its perceived poor domestic enforcement in respect to acts of bribing foreign officials. ‘Sapin 2” is intended to bring France’s global anti-corruption practices in-line with those practiced in other Western European countries and the US. In addition to boosting regulatory and enforcement bodies “Sapin 2” mandates that French companies, regardless of any previous corrupt practice, must strengthen their compliance procedures including (but not limited to); risk mapping, assessment of third parties and other intermediaries, as well as providing provisions to protect internal whistle blowers.
The European Chamber is delighted to be joined by Kenny Shek, Associate Managing Director, Kroll Aisa to share his experience on how companies can mitigate risk and specifically to address the impact of ‘Sapin 2’ on French companies operating in China, and to outline an effective approach that companies can take both locally and at HQ.
