Facing continued market access restrictions and a slowing economy, our latest Business Confidence Survey revealed that, while still largely committed to the market, 41% of European companies are planning to cut costs, including through head count reduction.
Even if we don’t take into account companies who may be actively cutting headcount, employee turnover and occasional employee disputes are an unavoidable reality. Companies need to protect themselves and ensure they are ready to deal with the difficulties of terminating an employee, especially one who they feel may be engaging in practices that are corrupt or potentially damaging to the company’s reputation.
The EU Chamber is delighted to welcome Lucas Jonsson, Partner at Mannheimer Swartling to take event participants through some key elements of the PRC Labor Law to highlight company’s legal obligations with regards to terminating an employee(s). Building on the legal obligations, Lars-Ake Severin, CEO, PSU China, will discuss some of the larger safeguards a company can put in place should an employee termination turn nasty, or should the employee in question have access to critical information or potentially pose a threat to the security of your intellectual property or to the physical security of other employees.
In follow up to their presentations Mr Jonsson and Mr Severin will tackle some of the tough questions that arise with employee termination and head count reduction, including; limiting increase in compensation packages beyond reason; securing assets and critical information ahead of a potential plant closure; using social media surveillance and developing communicating strategies to foresee and mitigate disturbances.
