2016 was a turning point in the way China deals with soil pollution. The 10-Chapter Soil Pollution Action Plan, issued May 2016, laid the foundation and was followed by a rapid rolling out of new initiatives, regulations and enforcement programs. In July 2017, the Soil Pollution and Prevention and Control Law (Draft for Comments) was published for public hearing.

On 27 June, 2017, the revised Water Pollution Prevention and Control Law was published and it will be effective on 1 January 2018. The revised law contains tough measures on drinking water suppliers and those who build sewage outlets in protected areas. The law also brings the “river chief” system into being and instructs more government initiatives.

These regulations bring along many requirements and liabilities for companies operating in China. With these new updates, The European Chamber has invited several experts to address these new requirements and liabilities on the new regulations on soil and groundwater contamination for enterprises and the practical approach to prevent soil pollution.

Johnny Browaeys is a corporate entrepreneur with twenty-four years cross-country and cross-cultural environmental experience bridging east and west.

Johnny set up the first Environmental Consultancy in Western China for ERM in 2005. At CH2M Hill he started the Environmental Engineering Business Unit pioneering soil and groundwater remediation in China. At BARCO he worked with the Chinese R&D team on product innovation and strategic marketing. During a sabbatical he developed cleantech exchange platform e8Resoures helping young professionals on the way supporting cleantech startups (eg. Seeder Clean Energy), after which he was approached by DuPont as corporate entrepreneur to create Sustainability Services for the China market. Currently Mr. Browaeys works with GREENMENT Environment supporting both western and Chinese companies inside and outside of China.

Over the past 15 years Johnny advised hundreds of foreign companies during Mergers & Acquisitions in China, originally mainly entering but more recently also exiting China. He worked closely with many multinational companies at various stages of project development, operation and closure, advised clients on applicable laws and their implementation, managing and mitigating environmental liabilities.

Rogers Wu has chemical engineering and law education background. Before he practices as lawyer, he has more than 10 years working experience at DuPont as technical engineer, manufacturing supervisor, project resource, EHS manager as well operations director. Now he is engaged as government counsel by Shanghai Environmental Protection Bureau and Shanghai Administration of Work Safety. In 2015, he was engaged to handle the “12·31” Shanghai Bund Accident (36 fatalities). He is the volunteering lawyer of All-China Environment Federation (ACEF), Friend of Nature (FON) and China Biodiversity Conservation and Green Development Foundation (CBCGDF). He is the lawyer of No.1 environmental public interest litigation in Suzhou as well as the lawyer for Changzhou Poisoned Land appeal case.

Rogers Wu and his team are experienced in providing EHS legal advices, training, permit application, compliance assessment, due diligence, emergency response, government interactions, hearing, administrative review, arbitration and litigation, etc. Now he is providing EHS legal services for a large number of fortune 500 companies including European companies.
