The European Union Chamber of Commerce in China is delighted to invite you to the launch of the European Business in China – Position Paper 2018/2019.
The European Business in China – Position Paper (Position Paper) is the European Chamber’s primary annual publication. Although the speed of China’s reform and opening up has accelerated over the past year relative to the recent past, it remains, in absolute terms, incomplete and too slow. The resulting increase in global tensions has culminated in a tit-for-tat exchange between China and the US, with the European business being caught in the cross fire.
While the European Chamber believes that tariffs are not an appropriate tool for resolving complex issues such as unfair technology transfers, market access barriers and an opaque regulatory environment, it does share the US’ impatience. Rather than resorting to swinging a hammer, the European Chamber has assembled its European Business in China Position Paper 2018/2019, which examines concrete concerns and offers recommendations that can help to provide a constructive solution to the current situation:
- 33 sub-papers covering different industries and horizontal issues begin with a holistic view of the sector before focusing in on specific issues and providing 828 corresponding recommendations to address the most pressing concerns of European companies operating in China.
- Concerns include broad issues like rule of law, market access, reciprocity and SOE dominance, as well as highly detailed ones like the need to clearly define specific terms in laws and regulations.
- The Executive Position Paper focusses on concrete examples of the 14 most common concerns faced by European companies across different industries, and catalogues them into a matrix by industry to highlight the ‘reform deficit’ that must be addressed to rebalance China’s trade and investment relationships and ease global tensions.

Mr. Carlo Diego D’Andrea
Mr. Carlo Diego D’Andrea
Founder and Managing Partner of D’Andrea & Partners Legal Counsel, and Founder of DP Group.
Graduated in Law at the University of Teramo (Italy), he then subsequently obtained a Masters’ degree in Corporate Advisor at LUISS University in Rome and a Diploma in Chinese Studies at Nanjing Normal University and is a member of the Italian Bar Association.
Mr. D’Andrea arrived in China in 2005 and is fluent in Italian (mother tongue), English, Mandarin Chinese and Spanish. He mainly deals with cross-border mergers and acquisitions, assistance in ODI/FDI and intellectual property rights.
He is also acting as Vice President of the European Chamber and Chair of the Shanghai Chapter.
Ms. Rosanna Terminio
Ms. Rosanna Terminio
With an international background in Europe and South America, and over 10 years living in China, Rosanna Terminio is a consultant, contributor and lecturer specializing in innovation and strategy for the organization, as well as human resources strategist. She works since 2006 for AsecorpChina, of which she become owner in 2011 together with a Chinese colleague. As an Independent researcher, she published an academic paper titled: “The impact of RAAI (Robotic, Automation and Artificial Intelligence) from the employee perspective. A scoping review” and she is now working on her PhD research about technology driven change and employee’s identity. She also contributed to the book “The work we need. People for Industry 4.0”, published in Italy in October 2018. Rosanna is certified as an Executive Coach (ICC) and LEGO®SERIOUS PLAY® facilitator. She gives lectures about Doing Business in China and HR Management in different Management Schools and Universities in Europe and China and participates, with pro-bono consulting, to different CSR activities.
Mr. Reinout van Malenstein
Mr. Reinout van Malenstein
Reinout van Malenstein is the National Vice-Chair of the IPR Working Group of the European Union Chamber of Commerce in China.
Reinout is Senior Counsel at HFG Law & Intellectual Property in China (Beijing, Shanghai and Tianjin), and is based in Shanghai. He advises companies on trademarks, copyright, patents, trade secrets, technology transfer, contracts and corporate law in China. Reinout has also worked on intellectual property for the European Commission in Greater China. Before that he was the head of the China practice at a leading Dutch law firm and a lawyer in the Netherlands on intellectual property at Freshfields Bruckhaus Deringer LLP. Reinout is currently the secretary of MARQUES China team. He regularly publishes articles on IP and speaks at both national and international conferences on IP. He holds a Master of Laws degree in Netherlands and EU IP law from Utrecht University and a Master of Laws degree in Chinese IP law from Peking University.
Ms. Isabelle Hajjar
Ms. Isabelle Hajjar
Isabelle is head of Compliance with Tek-ID China, a Digital Risk Intelligence company. She leads regulatory and operational compliance support, consulting, strategy and program design, implementation and roll-out services for Tek-ID’s clients in the ICT and digital sphere, both locally in China and on a global level (cybersecurity, data protection, infrastructure, market access conditions, organizational issues, policies and procedures, training, etc.), in various sectors (from classic hosting to cloud services, SaaS vendors, e-commerce, retail, banking, automotive, investment funds, health, digital security products, etc.).
She further acts, for certain clients, as outsourced General Counsel / Compliance and Data Privacy Officer.
Isabelle has, since mid-2016, been actively engaged in the European Chamber of Commerce of China as the Vice-Chair of the ICT Working Group - Shanghai, happily offering her support in their mission and lobbying activities.
Isabelle is also the co-founder and co-chair of the IAPP (Internal Association of Privacy Professionals) - Shanghai Knowledge Chapter, focusing on disseminating Knowledge and exchanging experience in all compliance matters for Data and Privacy Protection, as well as for neighboring subjects, such as cybersecurity.
Before joining Tek-ID, Isabelle had already accumulated some 19 years in the ICT - digital field, with 9 years as an Attorney in Europe, followed by in-house experience as General Counsel for ICT Companies, with additional skills
