The Decision on Amending the Law of the People's Republic of China on Individual Income Tax has recently been adopted at the Fifth Session of the Standing Committee of the 13th National People's Congress and will enter into force as of January 1, 2019.
The reasoning behind the reform seems to indicate that China wishes to reduce the burden on it’s working class, closing the loopholes evident in China`s personal tax regime and adhering to international tax norms. The Decision covers wide sweeping changes including the Residence Definition Change for Foreigners, the Worldwide Income Tax or the “183 Day Rule”, personal deductions for Chinese nationals and work permit holders, new general tax avoidance laws and a new tax bracket system.
D’ Andrea & Partners aims to break down what the changes in this amendment will mean for business in China, especially as it pertains to foreign business’ & foreigners living and working in China. As tax compliance becomes more intricate and regulated we will also look at tax compliance, what constitutes as tax avoidance and the reporting standards under the amendments for business in China.
