十三届全国人大常委会第五次会议8月31日表决通过电子商务法,共七章89条,对电子商务经营者、电子商务合同的订立与履行、电子商务争议解决、电子商务促进、法律责任等进行详细规定,将自2019年1月1日起施行。多次公开征求意见,历经四次审议,电子商务法终于问世。电子商务法的出台,对规范电商领域各主体行为,维护电商行业市场秩序,引导电商行业持续健康发展都有重要意义。
本会议将对以下几方面进行全方面答疑解读:

- 平台经营者的界定与责任?
- 电子商务行业发展又得到了怎样的规范和支持?
- 电子商务有哪些特殊合规要求?
- 跨境电商是否适用于电商法?
欧盟商会在电商法执行之际,特邀专家阿拉木斯-中国电子商务协会政策法律委员会副主任就《电子商务法》出台过程中特别受到关注的以上几个方面进行解读。同时,特邀冯晓鹏-金杜律师事务所合伙人将对跨境电商的具体合规问题分析(与《电子商务法》结合),电商平台责任与合规应对措施进行探讨。
On August 31, China’s first E-commerce law (the law) was passed by the Standing Committee of the NPC and is to take effect on January 1, 2019. The promulgation of the law is intended to standardize the behavior of various entities in the e-commerce sector, maintain market order, and to guide the sustainable and healthy development of the industry.
The law differentiates e-commerce operators such as merchants on e-commerce platforms from those who operate their business on independent websites, from Taobao to WeChat. The law also places increased emphasis on the obligations and responsibilities of the e-commerce platforms.
During the seminar a few significant provisions of the E-commerce Law will be highlighted:
- To what extent the new law better protects the legitimate rights and interests of consumers?
- The definition and responsibility of platform operators
- The expansion of existing e-commerce regulation
- What are special compliance requirements companies must follow relating to their e-commerce operations?
- E-commerce dispute resolution
- How is cross-border e-commerce affected by the e-commerce law?
With the e-commerce law set to take effect, the European Chamber is delighted to welcome Ala Musi, Deputy Director of the Policy Law Committee of the China E-Commerce Association and Feng Xiaopeng, Partner, King & Wood Mallesons to discuss the implications of the law for businesses operating in China.

Advisory Council Policy
Members of the Advisory Council may receive complimentary admission to Chamber seminars, conferences and factory visits up to two attendees per event. Additional participants will be charged at the member rate.
Advisory Council members will still be charged the standard member rate for participation in training courses and special events, such as gala balls, government appreciation dinners, or admission to corporate social events/tournaments.
