The European Chamber Southwest Chapter and D'Andrea & Partners Legal Counsel are delighted to invite you to join the IPR in China Overview & Protection of Companies IPR in Contractual Clauses of Commercial Contracts Seminar held on 29th May, 2019 (Wednesday) in Chengdu.

Concerns for the protection of intellectual property rights have been at the forefront of the international business scene for a number of years now, however, it has come to a head in recent years especially with Made in China 2025 and the The US-China Trade Dispute.

Although in recent years China has made great strides in order to move away from it’s image of‘Copycat China” the fact remains that China is still the origin of most counterfeit and pirated goods arriving in the European Union, as more than 80% of the seizures of counterfeit and pirated goods come from China or Hong Kong.

It is therefore essential that European firms, in particular smaller companies, to be aware of the threat of counterfeiting and piracy when engaging in business activities and thus allow them to prepare themselves accordingly. Therefore, the process of carefully selecting and monitoring business partners whether it be through conducting comprehensive due diligence on all suppliers and distributors prior to any business arrangements, or the protection of intellectual property rights can begin initially from the commercial contracts in which a company engages in, therefore, D’Andrea & Partners seeks to break down fundamentally the latest legislation in regards to IPR in China & on the international stage & where businesses engaged in the Chinese marketplace can establish Intellectual property rights prevention measures in their commercial contracts.

Advisory Council Policy 顾问委员会政策

Members of the Advisory Council may receive complimentary admission to Chamber seminars, conferences and factory visits up to two attendees per event. Additional participants will be charged at the member rate.

Shane Farrelly, Legal Advisor of D' Andrea & Partners Legal Counsel, Chongqing Branch. In this role he is responsible for the development of foreign invested businesses in the Chongqing/Chengdu area in collaboration with D' Andrea & Partners' offices globally, ranging from China, Italy, India and Vietnam.

A diverse educational background which ranges from Corporate Law to International Marketing Principles, from Universities such as National University of Ireland, Galway and Yonsei University, Korea. Mr. Farrelly has also obtained experience in the Criminal Defence arena in his native Ireland and has also been a regular contributor to well established international legal journals in relation to legal issues affecting both the Chinese and European markets.

Mr. Farrelly speaks English, Mandarin Chinese and Gaelic.

Mr. Zhi advises European and Chinese clients on various legal matters and business transactions in China and cross-border. His special focus areas are: foreign direct investment FDI, mergers & acquisitions, corporate restructuring, IPO and re-financing, commercial, real estate, construction, labor as well as dispute resolution.
Mr. Zhi also provides advices to the clients on outbound investment and immigration in Italy and Europe.
Mr. Zhi graduated in law from the University of Nanjing (China), and then awarded Master's Degree on Corporate Advisor (Giurista d'impresa) at Roma Tre University and Juris Master at the Shanghai Jiao Tong University Koguan Law School.

Mr. Zhi is acting Senior Partner of D’Andrea and Partners Legal Counsel Shanghai Headquarters with a long experience engaged in Sino-Italian Investment and Legal affairs and he can also count on a long experience within a leading Italian law firm in China with portfolio composed of both Chinese and International clients from 2010 to July 2013. A regular speaker on topics related to outbound investments in Italy. Mr. Zhi has served in public office for a few years therefore could assist the client in handling relationship with the governmental offices.
Mr. Zhi is registered in Shanghai Bar Association as qualified PRC Lawyer and has made speeches with topics regarding the investments in Italy on different seminars as well as published a vast array of articles regarding Sino-Italian legal affairs.
Mr. Zhi is fluent in his native Chinese, Italian and English.
