As the regulatory landscape evolves and new challenges arise for companies, general counsels and compliance departments have become increasingly important, helping organisations to adapt. As such, there is significant pressure on compliance professionals to ensure that companies meet their obligations.
The skillset of General Counsels and Compliance officers has had to increase in tandem with the volume and complexity of regulations. Where once compliance officers operated like lawyers, now they also need to be techies with a deep understanding of the technology estate. It is a multi-dimensional challenge.
Meanwhile, strategic trade control has quickly emerged as one of the major risks facing multinational companies. In May 2019, the US Bureau of Industry and Security (BIS) added several Chinese companies and organizations to the BIS Entity List meaning these companies are subject to license requirements for export, re-export or transfer of specific items. Following the recent US legislative curbs on doing business with or exports favouring certain Chinese firms due to concerns over national security, China published its own draft Export Control Law and the Catalogue of Technologies Prohibited or Restricted from Export.
With greater power, ownership of high-technologies, comes greater responsibility, increasing the importance of protecting trade secrets, creating an entirely new dimension to the role of Compliance Officers and General Counsels. In this year's Compliance Conference, General Counsels and Compliance Officers will discuss their evolving roles, and how to create synergy for optimal compliance and risk management.

Gao Min is IP head of 3M for Greater China Area & area General Counsel for CBG GCA, heading up a team of patent counsels and trademark professionals. Prior to joining 3M, she led adidas’ IP Team in China, working closely with its global IP team to align IP strategies, protect and enforce adidas’ IP rights in China. She was a litigator at Rouse & Co. International in Shanghai where she represented multinational companies on enforcing its IP rights in trade secrets, trademarks and patents. Prior to joining Rouse, Min was an official at the Shanghai Intellectual Property Office, a division of former State Intellectual Property Office (SIPO). Min was duly qualified as attorney -at-law (2003) and patent attorney (2004).

Cheng Wang is the General Counsel of Express (Hangzhou) Technology Company Limited, a joint venture of American Express that is licensed by the People’s Bank of China as the first foreign-owned bankcard clearing and settlement institution in China. As a member of the senior management team of the joint venture, Cheng heads the Legal Department of Express Company and oversees all legal and regulatory matters in its business operations. Prior to joining American Express, Cheng was the Head of Legal for Greater China of Morgan Stanley and was responsible for managing legal and reputational risk of the investment bank’s subsidiaries, joint ventures and business lines in China. Under his leadership, the Morgan Stanley Greater China Legal and Compliance Department won the Asia Legal Business Investment Bank In-House Team of the Year for 3 consecutive years. Cheng was included in the GC Powerlist China 2019 by The Legal 500 and received the Banking and Finance In-house Counsel of the year award from the China Business Law Journal in 2021. Prior to going in-house, Cheng practiced as a Senior Counsel with O’Melveny & Myers LLP, an international law firm, in both China and the United States for over eight years, representing clients in public and private financings, mergers and acquisitions, investigations and other general corporate matters.
Cheng is admitted to the bar of the State of New York and qualified as a lawyer in China. He is also a member of the Special Committee of the Shanghai Bar Association and co-authored International Business Law: Chinese and Comparative Perspectives, a course book for advanced business studies. Cheng holds an LL.M. degree from the University of Michigan Law School and an LL.B. degree from Shanghai University of International Business and Economics.

Lulu Mao is APAC Compliance Director of ASP (a Fortive Group Company). She leads Compliance and Integrity program for APAC and supports more than 12 countries. Lulu served other international companies in past 15 years, mainly focused on Legal and Compliance in life science industry, including Siemens Healthineers, St. Jude Medical and Covidien. Lulu holds a LLB degree from Tianjin Medical University and a LLM degree from University of Groningen, the Netherlands.

Jason Cao currently serves as Chief Legal Counsel at Dover Corporation Regional Headquarters, overseeing legal and compliance matters for Dover China and Southeast Asia. Jason’s practice areas include corporate law, contract law, employment law, M&A, regulatory compliance and dispute resolution.
Jason has over twenty years of work experience in multinational corporations and law firms. Prior to joining Dover in 2009, Jason served as Asia Pacific Region Chief Legal Counsel in Rohm and Hass., and a Partner in a Los Angeles law firm. He was a Lecturer in Law at Fudan University and a part-time lawyer in Shanghai prior to his departure for the U.S.
Jason holds a LL.M Degree from the University of California at Berkeley. He acquired his LL B Degree and LL.M Degree from Fudan University. He is a member of the California State Bar and has the Chinese Attorney Qualification.

Edwin Li is Vice President & General Counsel for DSM China in charge of the company’s legal, IP and compliance matters in Greater China.
Prior to joining DSM in 2017, Edwin served as General Counsel & Compliance Officer for a Fortunate 100 MNC’s China operations for 9 years. Edwin also practiced law for over 15 years with domestic and foreign law firms in China and USA with focus on cross-border transactions, M&As, foreign direct investments in China, technology licensing, general corporate and FCPA compliance. Edwin holds Master of Law from East-China University of Politics and Laws and Juris Doctor from University of Maine School of Law. Edwin is qualified to practice law in the Commonwealth of Virginia, USA and P.R. China, and an arbitrator at Shanghai International Economic and Trade Arbitration Commission. Edwin served as Chair/Vice Chair of Compliance & Business Ethics Working Group, EUCCC since 2015.

With over 19-years experiences in multinational corporation’s legal affairs management and compliance, Victor used to work in a Hong Kong red-chip mobile communication company, a multi-national cosmetics company, and a world-class retail conglomerate. His extensive experience has equipped him with rich business knowledge of various industries, a sharp sense of different industry sectors and legal practice experiences. Victor has worked at Henkel for over 13 years, during which he has led his team handled numerous and complicated legal affairs and projects in the areas of international & domestic restructuring, divesture, mergers & acquisitions, labor, anti-trust, tax, customs, dispute resolution, government affairs, compliance and corporate governance. Victor’s performances has won him a high recognition from the Headquarters’ management, and he was elected as one of the Top General Counsel in 2015 by Asia Legal Business of Thomson Reuters and ranked one of GC Influencer of Greater China by Chambers in 2018 and 2019 consecutively as well as GC Power-list by Legal500 for consecutive years. Amy Liu is a professional counsel with over 20 years of experience in P.R.C. legal & compliance field. Currently she’s the vice president of Shanghai Roche Pharmaceuticals Ltd, serving as the head of legal & compliance team, who advises on critical strategic and operational initiatives to ensure legal compliance and realization of business objectives. Amy obtained master degree from East China University of Political Science and Law, and LLM of Boston University School of Law. Before joining Roche in 2007, she served as legal manager in Vanguard Logistics Co. Ltd and Inchcape Group respectively.

Mr. David Y. Chen
David Y. Chen is counsel in the litigation and enforcement practice group. David focuses his practice on governmental and internal investigations, white collar criminal defense, trade secret matters, securities litigation, and complex civil litigation. With a particular focus in Asia, David represents clients in investigations relating to potential violations of the Foreign Corrupt Practices Act and other global anti-corruption laws. David also conducts anti-corruption due diligence and helps clients develop and implement internal compliance programs.
David has maintained an active and varied pro bono practice. On behalf of his clients, David has appeared and argued before the U.S. Immigration Court, the D.C. Superior Court, and an arbitral tribunal. He has also submitted briefs before the Supreme Court of the United States and the Board of Immigration Appeals. In 2016, David traveled to Nairobi, Kenya to participate in Ropes & Gray’s inaugural partnership with Lawyers Without Borders to train local practitioners on trial advocacy.
Prior to joining Ropes & Gray, David was a litigation associate at a large, international law firm in Washington D.C. While in law school, David interned at the U.S. Attorney’s Office for the District of Maryland and served as a student attorney in American University’s Criminal Justice Clinic. He competed in the Willem C. Vis International Commercial Arbitration Moot Court in Vienna, Austria and was recognized with an honorable mention for Best Oral Advocate.

Geoff is a partner in the Litigation and Enforcement practice group at Ropes & Gray in Hong Kong. Geoff advises public companies, fund sponsors, and financial services clients in the U.S. and throughout Asia in connection with civil and criminal government enforcement matters before the SEC, DOJ, and other state and foreign regulators, and in connection with complex securities and commercial disputes.
Geoff regularly advises corporate management and directors conducting internal investigations, evaluating sensitive governance issues, and establishing regulatory compliance programs. Geoff has particular experience advising clients regarding potential violations of global anti-corruption, anti-money laundering, and sanctions laws, conducting international risk assessments, and evaluating risks associated with complex mergers & acquisitions in India, China, and throughout Southeast Asia.
Geoff has extensive experience working with clients in the pharmaceutical, medical device, and technology sectors, as well as private equity funds, investment advisory firms and broker-dealers.

Clarissa SHEN had been Sanofi China Head for Global Ethics and Business Integrity function since Feb. 2012. Her main responsibilities are to partner with Sanofi China Country Chair to ensure the affiliate’s business operation to the company’s highest ethical standards. Since Oct. 2020, Clarissa has taken up a new role as Head of EBI China Strategic Competence Development in ensuring that the E&BI department incorporates compliance risk areas across its disciplines and foster the competencies development of China team. Between 2017 and 2019, Clarissa has co-chaired the Compliance Working of RDPAC (An industry association, affiliated to CAEFI, consists of 42 Pharma MNCs), where she won the award of 2018 RDPAC Code & Ethics Ambassador and 2019 RDPAC Best Contributor. In 2020, Clarissa acted as the keynote speaker for Post Covid-19 Compliance Conference for Healthcare Industry in China (financially sponsored by the World Bank for a Siemen’s Global Compliance Program, centred at East China Normal University), on behalf of RDPAC and its member Sanofi.
In 2017, Clarissa co-authored an article of “An Overview of Compliance in China – the Pharma Sector”, which was published by the German HAUFE. The book is entitled as “Governance, Risk and Compliance Management in China”.
Clarissa has been a Board member for European Union Chamber of Commerce (EUCCC) Shanghai Chapter since Mar. 2016. During 2017 EU Delegation Tour to Brussels, Clarissa, in team with EUCCC China President and RDPAC Managing Director participated a high-level dialogue with EU DG SANTE Commissioner Vytenis Andriukaitis and his team, to have exchanged views on Rare Disease Reimbursement Policy and Business Ethic.
Apart from Sanofi, Clarissa has 20+ years’ business and people management experiences in terms of customer service/demand planning/business operation/credit and supply chain management/distributorship management with BMS, Eli Lilly and Ciba Specialty Chemicals.
Clarissa holds a bachelor’s degree from Shanghai University and an MBA degree from University of Canterbury, New Zealand. In year 2019, she was nominated as the first International Board member for Canterbury MBA association.

Mr. Marcel Radunski has a proven track record as General Counsel and Head of Compliance in Asia, Middle East, and Europe managing and empowering international teams in challenging and changing environments. Marcel is convinced that integrity is the basis for sustainable business success.
Marcel studied law, political science, and history in Bonn, Germany.
He is a fully qualified German lawyer (‘Rechtsanwalt’) admitted to the bar in Berlin, Germany. In 2004 he started out as an associate and later junior partner in a law firm in Berlin, Germany with focus on international business law and EU funding.
In 2007 he joined Siemens AG as Legal Counsel working first in Erlangen, Germany later in Berlin, Germany, for Siemens Mobility’s Turnkey Business.
In January 2009 he was appointed Senior Legal Counsel for the Siemens Road Business (ITS) in Munich, Germany.
In the fall of 2009, he was assigned to China supporting major Siemens Mobility projects.
From April 2011 until September 2014 he was Vice President and Head of Legal in Siemens AG’s Representation Office in Brussels, Belgium, establishing and heading the Legal Government Affairs team with 3 direct reports.
Between October 2016 and August 2018 he was General Counsel Legal and Compliance Siemens Qatar and Levant Region based in Doha, Qatar, establishing the Legal and Compliance team with 5 direct reports.
From September 2016 until December 2018 he was Regional General Counsel and Head of Compliance Asia Pacific – Greater China for Siemens Healthcare Ltd., China based in Shanghai establishing the Legal and Compliance team with 20 direct reports and managing the carve out and IPO of the Siemens Healthcare business.
Since January 1, 2019 until August 2020 Marcel is Vice President and Head of Compliance Greater China at Siemens Ltd., China based in Beijing heading a team of over 30 Compliance professionals. At the same time Marcel is heading the Siemens Compliance Asia Australia Collaboration Circle. From September 2020 Marcel is the Vice President and General Counsel of Siemens Greater China.

David Shi is Syngenta’s Compliance Officer for China and APAC (excl. South Asia). Prior to joining Syngenta, David had ever worked for Siemens Healthineers as senior investigator and Junhe LLP as a lawyer focusing on dispute resolution.
David has fundamental experience on litigation/arbitration, daily compliance and internal investigation. David also focuses on the industries such as agriculture, pharmacy and medical device.
David graduates from East China University of Political Science and Law.
