After China’s proposal for a ‘Global Data Security Initiative’ in September 2020, China has stepped up its cyber-related legislation in 2021 with an unprecedented speed. This is especially reflected through the promulgation of two data related superordinate laws that will work together with the Cybersecurity Law: one is the Data Security Law (DSL), which came into effect since 1st September 2021, and the other being the Personal Information Protection Law (PIPL), to be enacted on 1st November 2021.
The two laws, along with other recently promulgated regulations falling under the Cybersecurity Law, are to bring heavy impact to the business community in China. Foreign companies that previously had a global approach to data protection and compliance are pressed to revise their regional cybersecurity compliance and re-organize its China strategy vis-à-vis the new regulations, as the new laws and regulations might pose restrictions, additional compliance burdens, or risks, to their current cybersecurity practices.
The European Chamber is delighted to invite our members to our annual Cybersecurity Conference, where we invite the right experts, at the right time, to decipher the increasingly complicated cybersecurity management framework in China to better prepare our audience to what is coming or is present.
自2020年9月中国提出“全球数据安全倡议”后,中国以前所未有的速度在2021年加大了网络相关的立法速度。这尤其体现在今年下半年发布的,与《网络安全法》共同监管中国网络安全环境的,两部数据相关上位法:《数据安全法》(自2021 年 9 月 1 日起实施)与《个人信息保护法》(将于 2021 年 11 月 1 日起实施)。
双法的实施,连同《网络安全法》框架下新发布的其他政策法规,将给中国商界带来颇大的影响。以前在数据保护方面采用全球统一合规方法的在华外资企业须修订其区域网络安全合规性,并针对新出台的法规重新制定其中国战略,为新法规可能带来的网络安全合规负担或风险做充足的准备。

Mr. Nicolas Chapuis
Mr. Nicolas Chapuis
Mr. Chapuis began his career in the 1980s as the Press Attaché at the Embassy of France in Beijing. In 1983, he was appointed Second Secretary (Political Affairs) at the Embassy of France in Beijing and then Desk Officer for China, Taiwan, Hong Kong, and Mongolia at the Asia-Oceania Department of France’s Ministry of Foreign Affairs (MFA). Between 1987 and 1988, he was a CFIA Fellow at Harvard University.
In 1988 and 1989, he held the position of Desk Officer for NATO & European Security at the Political Affairs Department of France’s MFA. From 1989 to 1992, he was the Cultural Counsellor at the Embassy of France in Beijing.
Mr. Chapuis's diplomatic career continued in the role of Deputy Chief of Mission at the Embassy of France in Singapore. Following this, he held the position of Personal Assistant to the Deputy General Secretary for European and Economic Affairs at the MFA before becoming the Deputy Director (East Asia) of the Asia-Oceania Department of the MFA from 1995 to 1998.
In 1998, returned to China as the Consul General in Shanghai. Between 2002 and 2003, he was First Counsellor (Cultural Affairs) at the Embassy of France in the United Kingdom and the Director of Institut français du Royaume-Uni.
From 2003 until 2005 Mr. Chapuis served as Ambassador of France in Mongolia and in 2005–2009 he was Deputy Chief of Mission at the Embassy of France in Beijing.
In 2009–2010, served as Prefect of the département of Hautes-Alpes. Following this, held the position of Chief Coordinator of the MFA WikiLeaks Taskforce until 2011.
Mr. Chapuis has been the Ambassador of France to Canada since February 4th, 2015. In September 2018 was nominated as Head of the EU Delegation to China
Mr. Carlo Diego D’Andrea

Founder and Managing Partner of D’Andrea & Partners Legal Counsel, and Founder of DP Group.
Graduated in Law at the University of Teramo (Italy), he then subsequently obtained a Masters’ degree in Corporate Advisor at LUISS University in Rome and a Diploma in Chinese Studies at Nanjing Normal University and is a member of the Italian Bar Association.
Mr. D’Andrea arrived in China in 2005 and is fluent in Italian (mother tongue), English, Mandarin Chinese and Spanish. He mainly deals with cross-border mergers and acquisitions, assistance in ODI/FDI and intellectual property rights.
He is also acting as Vice President of the European Chamber and Chair of the Shanghai Chapter.

Clas Neumann is Global Head of the SAP Labs Network since 2009, and has been leading the Fast Growth Market Strategy team since 2013. In his role as Labs Head, Neumann acts as the central coordinator of all network activities. In his role as Head Fast Growth Market Strategy he leads the investments for SAP’s growth markets in Africa, China, Middle-East and Russia. Neumann has co-authored different books & article son innovation in emerging markets and been recognized through different awards for his engagement in society and business.

Dr. Yanqing Hong is Professor in Beijing Institute of Technology. He focuses on data protection, cross-boarder data flow and cybersecurity related legal issues. He now leads the standardization project on personal data protection under the National Information Security Standardization Technical Committee of China, and acts as deputy head of the drafting task force for Guidelines for Data Cross-Border Transfer Security Assessment. He regularly participates in the bilateral or multilateral dialogues on cyber related issues, such as China-EU Digital Economy and Cybersecurity Expert Working Group which is organized by the Cyberspace Administration of China and DG Connect of the EU Commission. He received his Ph.D. in Law from the School of Law, Utrecht University, the Netherlands.

Mr. Chen Jihong
Chen Jihong is a Partner at Zhong Lun Law Firm and is widely regarded as one of the leading cyber security and IP lawyers in the PRC having advised some of the world's largest companies, both foreign and domestic.
Mr Chen’s main areas of legal expertise include: TMT Law, Intellectual property protection, IP portfolio management, IP licensing, e-Commerce, Privacy and data protection, anti-unfair competition, cyber security, domain name dispute resolution, IT and High-tech related legal matters.
Fluent in both Chinese and English, Jihong received his Masters at Tsinghua University in 1996, before graduating from Chicago-Kent College of Law in 2002. Mr Chen is widely published in leading academic journals and has received numerous awards domestically in the areas of IP and telecommunications law, most recently Mr. Chen was selected as “2015 China Top 15 IP Lawyers” by Asia Law and Business and in 2016 was awarded “Telecommunications Law -Lawyer of the Year in China” by Corporate INTL.
Dr. Jiyin Li

Li Jiyin, head of the cybersecurity industry promotion team of the Cybersecurity Industry Development Center of the Ministry of Industry and Information Technology. She holds a Ph.D. in Engineering from the Beijing University of Posts and Telecommunications and is a senior engineer. She has long been engaged in research work in the field of digital economy and cybersecurity, and has repeatedly presented China's policies and excellent practices in APEC and other international forums as a think tank representative from China.

Ms. He Shanshan is Executive President of ICMA Research Institute Ms.He Shanshan is also the expert of Autonomous DrivingLaw and Policy Expert Panel of China Transportation Department, and expert of Autonomous Driving Law Expert Committee of Beijing.
She has been closely working on the automated driving projects and conducting research and advice on law, policy, ethics and standards regarding AI and autonomous driving. She also keeps close communication and cooperation with industry field, academic field and relevant authorities domestically and overseas on AI and autonomous vehicles.
She obtained the bachelor of law degree and master of law degree from Tsinghua University School of Law, the master of law degree from Columbia University in New York and the master of international law degree from the University of Hong Kong. She is both qualified in P.R. China and New York of the United States. With respect to working experiences, she used to work at Clifford Chance and led the legal department of Audi in China.
Dr. Wu Shenkuo

Law Professor and LLM Tutor of College for Criminal Law Science & Law School at Beijing Normal University. He gets his PhD and Post-doctor at University of Verona. He is also the associate researcher at the University of Verona and contract researcher at the University of Turin, as well as senior consultant of United Nations for cybersecurity and cybercrime issues, consultant at the Supreme Court of China, consultant of Politics and Law Committee of Beijing, Secretary-General of Research Centre of Internet Society of China, editorial board member of authoritative criminal journal Diritto Penale XXI Secolo, consultant of QS Ranking Group for academic reputation of international universities.
Prof. WU is specialized in Cyber Law,ICT Criminal Law (Cybercrime), Economic Criminal Law (White Collar Crime), Comparative Criminal Law and International Criminal Law (European Criminal Law). Prof. WU has already published, in Italian and English, one piece of monograph, two pieces of books in collaboration with his research team, about 10 pieces of articles on the foreign core journals and completed the Italian translations of Chinese Criminal Law, Criminal Procedure Law and Judicial Interpretation of Criminal Law. Besides, Prof. WU has also published more than 10 pieces of articles on CSSCI journals like Tsinghua Law Review and core presses like Guangming Daily. For the research projects, Prof. WU has been in charge of several international academic projects funded by Italian Central Bank, University of Turin, Cariverona Foundation, etc and several national academic projects funded by Chinese National Social Science Funds, China Scholarship Council, Beijing Normal University and so on.

王新锐律师长期深耕网络安全和数据保护业务,其提供深度法律服务的客户包括数十家中外顶级科技公司,亦为多个中央部委和地方政府的数据立法和监管工作提供支撑。王新锐律师作为中方专家,入选ICC(国际商会)、B20(二十国集团工商峰会)等国际组织的数字治理工作组。此外,王新锐律师是《个人信息保护国际比较研究》《数据服务框架》两本书的主要作者,并有大量文章和译作公开发表,专业观点经常被新华社、人民网等国内外主流媒体引用。近两年,王新锐律师作为课程讲师在北大、清华等多所著名高校讲授网络法和数据保护相关内容,并兼任对外经贸大学法学院高级研究员。2018年以来,王新锐律师在TMT和数据保护领域先后获得Chambers、The Legal 500、ALB、《商法》、China Law & Practice、asialaw、LEGALBAND等多个法律专业评级机构的推荐,其中包括ALB China十五佳TMT律师、The Legal 500亚太数据保护领先律师(2021-2024)、LEGALBAND中国顶级律师排行榜:网络安全和数据保护(第一梯队)(2019-2023)等个人奖项。
Raymond Wang graduated from Tsinghua University, Faculty of Law, with a degree of LLB and has been practicing law for more than 18 years.
Raymond’s focus is on cybersecurity and data protection and frequently advises leading multinational and domestic technology companies and ministries and local governments with respect to legislative and regulatory programs.
Raymond sits on the expert panel for the ICC’s Data Governance Working Group and the B20 Organization Compliance Working Group. He is one of the key authors of the monograph “International Comparative Study on Personal Information Protection" and “Data Service Framework". He has published many articles, reports and translation works in the field of personal information protection, and also has taught courses related to data protection and cyber law in Peking University and Tsinghua University.
He was listed as one of the 2021 ALB China Top 15 Lawyers in TMT area by Asian Legal Business and as "Leading individuals in data protection area" by The Legal 500. The awards he has gained also include China Top 15 Lawyers – Cybersecurity and Data Protection (Tier one) by LEGALBAND in 2019, 2020 and 2021.

Dr. GONG Renhai, Director of Policy Research, SAP Greater China, who also serves as the National Chair of Cybers-security Sub-working Group under EUCCC. He mainly focuses on tracking legal and practical research on Cybersecurity Law, Cryptography Law and other related digital economic laws and regulations, Foreign Investment Law, Autonomous and Controllable Policy. Dr. Gong has been working in central government agencies for near two decades, who was mainly engaged in the WTO Rules Negotiations in Doha Round, consultations of bilateral free trade areas, competition law, trade remedy law and IPR border enforcement. His diplomatic mission lasted for three and half years in the Chinese Embassy in Washington D.C., whose responsibilities were to deal with trade frictions and to study IPR legislation and judicature.
In 2002, he was awarded Master of Arts degree (High Distinguished) in International Relations in Economy and Trade from Flinders University of South Australia. In 2014, Renhai got Ph.D. degree (cum laude) in the major of International Economic Law in China University of Political Science and Law (CUPL). In addition, he was nominated as a senior fellow in the Faculty of Law at the University of Hong Kong (HKU) under Swire Group Scholarship Award.

Caroline is currently (2021-now) in charge of Strategy & Ecosystems in Detecon Consulting China, a subsidiary of Deutsche Telekom. She leads the local marketing and ecosystems buildup and works in strategy consulting project on ICT topics for international clients.
Caroline Chen was the Head of Business Development in Deutsche Telekom Representative Office Beijing. She led the local BD Team, in charge of regulation tracking, partnering development, standardization coordination and innovation scouting for Deutsche Telekom group units. She has been with Deutsche Telekom starting from 2012.
In addition to the work at Deutsche Telekom, Caroline Chen has been actively engaged in European Chamber and has been elected for the Vice Chair and then the Chair of ICT working group in the past several years. As one of the leading pens for the ICT position paper, she contributed substantially to the key recommendations writing and editing. She also initiated and actively participated at the dialogues between governmental bodies and ICT working group in order to promote the common interests of European industry in China.
Prior to joining DT, Caroline Chen was an analyst in an American consulting firm Marbridge Consulting, where she worked mainly for clients including European telecom companies and American venture capitals & PEs for understanding the Chinese telecom and internet industries.
Caroline Chen was graduated from Central University of Finance & Economics with a master’s degree in economics, and from Beijing Foreign Studies University with a Bachelor Degree in English Literature.
Ms. Xiaowen Ma

Xiaowen Ma serves as Senior Public Policy Manager for Infineon Technologies. She currently chairs the European Chamber’s Cybersecurity Sub-working Group. Prior to this role, Xiaowen worked as Senior Business Manager at the European Chamber, where she was responsible for the Information and Communication Technology Working Group and the Cybersecurity Sub-working Group, led the Chamber’s engagement with Chinese and European governments and other stakeholders in the ICT field, and provided counselling to European companies on market entry and regulatory issues, especially on cybersecurity, encryption, data protection and telecoms/cloud.
Xiaowen holds a Master’s degree in European Affairs from Sciences Po Paris, and a Bachelor’s degree in French Language and Literature from Renmin University of China.
