【中文活动】如何正确应对行政执法及行政处罚——从《行政复议法》修订草案解读说开去

Recently, after the 37^th session of the 13^th Standing Committee of the National People's Congress (NPCSC), NPCSC has initiated the public consultation of the Administrative Reconsideration Law (Draft for Comments), which has been reviewed in the conference. One of the key takeaways is that the role of the administrative review in handling administrative disputes will be strengthened, as stipulated in the draft. The Administrative Reconsideration Law was formulated in 1999 and amended in 2009 and 2017. While by the end of 2021, China's administrative reconsideration organs at all levels had handled 2.953 million cases, with an error correction rate of 14.3%.

近期十三届全国人大常委会第三十七次会议对《中华人民共和国行政复议法（修订草案）》进行了审议，并就该修订草案征求社会公众意见。值得关注的是，在修订草案的立法宗旨中明确指出要发挥行政复议化解行政争议的主渠道作用。现行行政复议法制定于1999年，并于2009年和2017年分别对部分条款作了修订。截至2021年底，中国各级行政复议机关共办理行政复议案件295.3万件，纠错率14.3%。

The presentation will focus on administrative enforcement and penalty issues related to the Administrative Law, which might occur in foreign-invested enterprises' daily operations. The meeting will take place from 10:00 to 11:30, 11 November.
