2022年是我国在数据治理领域取得较大立法进展的一年。在数据跨境合规方面,有关规定、草案密集出台,明确了数据出境的各种路径:如通过网信部门组织的安全评估,进行个人信息保护认证,以及与境外接收方订立标准合同,也对企业提出了迫切的合规要求。
国家互联网信息办公室发布的《数据出境安全评估办法》(以下简称“《办法》”)于2022年9月1日正式施行。按照《办法》要求,满足安全评估申报门槛的数据处理者需通过评估后方可向境外提供数据,其既有数据出境活动,需在2023年3月1日前完成整改。
随着整改时间节点的临近,本期“网络安全合规”系列活动有幸邀请世辉律师事务所合伙人王新锐律师,分享当前数据出境安全评估推进情况,梳理安全评估的重点、难点,并对2023年数据出境合规工作进行展望。

China has made significant legislative progress in data governance in 2022. Several channels have been established for lawful cross-border data transfers, namely passing a security assessment conducted by the cyberspace authorities, obtaining a personal information protection certificate, and signing a standard contract with the overseas data recipient, which prompting enterprises to make imminent compliance efforts.
The Measures for Cross-border Data Transfer Security Assessments (Measures) issued by the Cyberspace Administration of China (CAC) came into effect on 1st September, 2022. According to the measures, data handlers meeting the pre-specified thresholds have to apply for a cross-border data security assessment before transferring their data across borders, and existing transfers will have to become fully compliant by 1st March, 2023.
With 1st March drawing near, in the tenth edition of Cybersecurity Compliance Series, the European Chamber is delighted to invite Mr Wang Xinrui, partner of Shihui Law Firm to share an overview on developments in China’s cross-border data security assessment, help enterprises to better understand the key points and difficulties with regard to cross-border data security assessment, and provide an outlook on cross-border data transfer compliance in 2023.
This event will take place in hybrid format, and held in Chinese without interpretation services; onsite seating will be reserved on a first-come-first-served basis.

Advisory Council Policy
