Dear Legal WG member,
The European Chamber is delighted to invite you to the next meeting of the Competition Sub-Working Group which will take place on Monday 24th August, from 9:00 am -10:30 am. The meeting will be in the European Chamber's offices in each of Beijing & Shanghai, with a telephone link between the two locations.
The meeting will cover recent developments in the enforcement of the Anti-Monopoly Law of China. In addition, Mr. Francois Renard (Vice-Chair, Legal WG Beijing, Co-Chair, Competition Sub-WG) will be presenting details of the SAIC’s informal draft regulations relating to the abuse of IPR Under the AML and the potential implications for members. Members of the IPR WG (BJ & SH) will also be invited to attend this section of the meeting.
Members in chapters other than Beijing and Shanghai will be able to join the meeting either in person or via conference-call link-up at Chamber offices.
Agenda:
1. Presentation by Mr. Francois Renard on the draft regulations on the abuse of IPR
2. Other recent developments in AML enforcement:
- Overview of and reflections on one year of the AML
- Notification thresholds for financial institutions
- Relevant Market definition guidance
- SAIC procedural rules
- Status of SAIC draft guidance
- Status of MOFCOM draft guidance
- NDRC’s call for comments on the draft rules of Anti-pricing monopoly
- Further guidance available in discussion drafts only (I.E. SPC Guidance on AML civil cases)
3. Recent AML-related lobbying activates by the Chamber:
- Submission of comments to SAIC
- Follow-up meeting with Ms. Cao, Division Director, SAIC Anti-monopoly Enforcement Bureau
4. Planned lobbying activities: Brussels Circuit, proposed meetings with MOFCOM and NDRC
5. Proposed Breakfast Seminar(s) on “The AML One Year On”
