The European Chamber is pleased to invite you to join a seminar about bribery and corruption in China this November.
Bribery and other forms of corruption easily creep into business activities as companies seek to win new contracts or when they engage third parties to buy or sell their products and services. Yet, the recent rise in the number of prosecutions involving senior government officials and business executives in China show the increasing teeth of local anti-corruption laws and the Chinese government’s resolve to tackle corruption at every level in the country.
No industry is immune and ignorance is no longer a defence for foreign companies as the Foreign Corrupt Practices Act (FCPA) has broadened its scope of bribery and corruption to include payments made by intermediaries.
This event targets legal practitioners as well as risk and finance managers from all industries who face challenges in ensuring compliance with business policies and local and extraterritorial legislations. Our speakers will cover the following areas:
- Common forms of bribery and corruption
- Differences between bribery and facilitation payments
- Laws governing bribery and corruption in China. US-FCPA and EU-OCED legislations and enforcement
- Identifying red flags across all business functions and dealing with them
- Reputational risks for breach
- Strategies for ensuring compliance across internal business functions and external business relationships
Speakers
• Ben Wootliff, Head of Corporate Investigations, China, Control Risks
Ben Wootliff is head of Control Risks corporate investigations an business intelligence operations in China. Ben has carried out more than 200 investigative due diligence, litigation support, fraud and investor intelligence assignments in Asia, Europe, and Latin America.
Prior to moving to China, Ben managed Control Risks’corporate investigations financial services practice, which was responsible for the company’s relations with investment banks, private equity firms, and asset managers. Before joining Control Risks he was a journalist specialising in business and finance. He graduated from the University of Birmingham in with a BA in Modern History and Political Science.
• Rainer Burkardt, National Partner, Shanghai and Frankfurt, Squire, Sanders & Dempsey
Mr. Burkardt is a member of the Board of Directors of the German Chamber of Commerce in Shanghai and in 2009, was appointed a trusted lawyer of the Consulate General of Austria in Shanghai by the Austrian Government. He also serves as vice chair of the legal working group of the European Chamber in Shanghai. He received a scholarship from the German Academic Exchange Service (DAAD – Deutscher Akademischer Austauschdienst) for a two-year program, including language studies, at Beijing Normal University in China.
Prior to joining Squire Sanders, he established an office in Shanghai for a leading independent German law firm. He is the author of articles in several PRC-related magazines and a frequent speaker in PRC-related seminars.
