Event Abstract
The European Chamber PRD IPR Working Group will hold a Round Table seminar focusing on Cooperation in Criminal IPR Enforcement together with the main authorities responsible for criminal enforcement in the Guangzhou area:

The meeting will be chaired by a specialist in criminal enforcement from Rouse & Co., an IPR consultancy. During the meeting the following topics will be discussed with the officials involved:
1. Summary of key challenges in IP criminal prosecution in Guangdong
2. Overcoming challenges is transfer of cases from administrative to criminal system
3. Overcoming challenges in valuation of criminal cases
4. Best practices for IP owners

European Chamber Round Table on "Cooperation on Criminal IPR Enforcement", Guangzhou, 26 November 2009
The EUCCC hosted a round table in Guangzhou on 26th November with the aim of having an informal discussion on better cooperation between rights holders and authorities handling criminal prosecution of IPR crimes.
Representatives from the Economic Inspection Office of Guangdong Provincial Public Security Bureau, the Price Certification Center of Guangzhou City Price Evaluation Bureau, the Inspection Office of Guangzhou City Quality and Technology Supervision Bureau and the Trademark Section of Guangdong Province Administration of Industry and Commerce attended.
The topics discussed included:
Difficulties arising when enforcement actions by administrative authorities are transferred to the PSB for criminal investigation
Complexities in price evaluation to determine the illegal turnover
Procedures for transfer and deadlines for PSB to accept cases
Best practices for rights owners when handling potential criminal cases

A key issues arising from the meeting for EU Chamber members are the importance of thorough preparation of cases that may be potential criminal cases. One of the main points of failure is that administrative authorities receive complaints and conduct “raids”, but the whereabouts and identities of key suspects are not confirmed, so no prosecution can follow. All the participants stressed that where a potential criminal case is identified, the rights holders and their agents should take time to identify the suspects and key locations, and also notify the PSB, so that ideally, both administrative officers and PSB officers can attend the action at the same time and transfer the case on site if applicable.
