The discussion will cover the following questions :
i) Non-identical trademarks. What is the scope of Customs’ powers to detain products which bear a similar but not identical trademark? Can they use their discretion, consult the AIC, or must release? (If possible, we should present some theoretical examples).
ii) Criminal offences. Where the scale of the seizure has clearly exceeded the thresholds for criminal prosecution, can Customs transfer the case to the PSB? What are the legal and practical considerations?
iii) Disclosure of information relating to the seized goods. It is customary that Customs will not release any information relating to the consignment of seized goods (for example, the BOL or Customs declaration) on the basis that this may “violate the trade secrets” of the other party. Can Customs clarify what rights to confidentiality the infringer has, the justification for this, and whether such rights include all the information relating to the shipment, or only some?
iv) Some IP owners who do a lot of licensing may have literally thousands of authorized suppliers of licensed goods shipping out of China. It is practically very difficult both to keep the authorized supplier database updated. They have found that authorized shipments are often held up, even where the exporter has truthfully declared that the products carry a brand (which counterfeiters never do!). What suggestions does Huangpu Customs have for this problem?
