We will have the honor and pleasure to welcome Mr Tom Carver, Chief Executive Officer for Wragge & Co.
He will give a presentation on "Hong Kong shadow companies".
An increasingly prevalent strategy of infringing companies is to establish a Hong Kong 'front' company with a typically infringing name such as 'Hong Kong Wragge' or 'Hong Kong Nike' which sells infringing products via a website, but which has very little other involvement in the business. Products are produced in and shipped from China, payments are made to Chinese bank accounts, etc.
This presents difficulties for rights owners: suing the Hong Kong company may not be worthwhile because that company generally has no assets; suing the Chinese company may be impossible because of the heavy burden of proof required in China to link infringing sales to the defendant.
Tom Carver will describe this strategy and explain how best to combat it.

About the speaker:
Tom Carver is the Chief Representative of Wragge & Co in China. Tom specialises in intellectual property litigation and, having represented clients numerous times at the Courts of First Instance and Appeal and twice before the Supreme Court/House of Lords in England, he now advises household names such as Dyson on their IP strategy in China. Tom has extensive experience of working as part of tran-national litigation teams, developing and implementing strategies with lawyers from up to 30 other jurisdictions for pharmaceutical giants such as Eli Lilly and Angiotech.
