The Chamber is extremely pleased to announce the nomination of Jean Kowalski, Vice President - Legal and Commercial, of Aker Kvaerner as new Chairperson. At the same time the Chamber welcomes candidatures for the position of Vice Chairperson and encourages all members to actively support the Working Group. Please contact Maurizio Andreano for details.
During this meeting we will discuss and distribute the responsibilities for drafting the 2006 Position Paper. Please be reminded that the deadline for the English version of the Position Papers isFriday 30th June 2006. The Position Paper is the key tool of the Working Group, developing dialogue with authorities in Europe and in China. Our meeting will be more productive if you are able to give some consideration to these and additional issues that affect your business operations in China. Please provide any input or feedback ahead of the meeting to Maurizio Andreano at mandreano@euccc.com.cn.
Tentative key recommendations 2006:
- Grade of companies working in a consortium
Allow construction companies working in a consortium to undertake work within the higher of the entities’ qualification grades.
- Flexibility in the application of the capital and asset requirements
Introduce some flexibility with respect to the application of the registered capital and asset requirements for foreign-invested construction companies by allowing such companies to meet and/or augment their registered capital requirements with financial instruments.
- Circular 159 concessions for the design regime
Apply the concessions granted under Circular 159 for foreign-invested construction companies to the design regime under Decree 114 and remove the requirement under Decree 114 that a certain percentage of the architects and engineers employed by a foreign-invested design company must be foreigners qualified in China.
- Allow cross-border provision of project management services
Allow off-shore entities to obtain project-by-project licences to provide project management services within the PRC.
- Issue drafts of pending regulations for consultation on an expedited basis
Specifically, issue a draft of the Decree 114 Implementing Rules and the “Regulations Regarding the Administration of Foreign Investment Construction Service Units” for consultation on an expedited basis.
