China Customs are active in conducting post-importation audits and investigations of critical industries, sensitive commodities and leading multi-national import/export enterprises. In recent years, nationwide audits and investigations have been initiated by China Customs to ensure trade compliance as well as revenue collection. The focus of audits and investigations may specifically include customs valuation, bonded manufacturing and other duty exemption programmes.
Valuable management time and resources are typically spent 'fire fighting' these issues and significant financial exposures can result in the event of non-compliance, e.g. financial penalties imposed by the Anti-smuggling Bureau (ASB) after investigation. Disputes between enterprises and Customs can arise especially given the nuances of regulatory interpretation and enforcement in China. Resolution of these disputes in a manner that balances relationships and expectations with compliance and fiscal control is essential.
You are invited to our workshop wherein you can learn more about the strategic and tactical approaches to deal with disputes with Customs during an audit or investigation. In particular, we will share with you our observations on the trends of customs audit pertaining to customs valuation and how to manage the ASB before and during a customs investigation.
