The European Chamber is pleased to invite you to the next Legal & Competition Working Group meeting + Vice Chair Election. It will be held on Thursday, 25 September, 4pm-6pm, at the European Chamber Beijing and Shanghai offices via video conference.
At this meeting, Mr. Jiang Liyong, Partner, Gaopeng & Partners, and an official from MOFCOM will give a presentation on “What the new Rules to Strengthen the WTO Rules Compliance issued by the State Council of China will bring to MNCs?”.They will give some insights on the enactment and implementation of the Notice to Further Strengthen the Compliance of Trade Policies (“Notice”), as well as questions regarding how to propel the market access for foreign-invested companies and improve the national treatment via such mechanism. The notice was issued on June 16, 2014 by the General Office of the State Council of the People's Republic of China in order to implement the guiding principles set out at the Third Plenary Session of the Eighteenth CPC Central Committee, and it is believed that this rule will help to set up a mechanism for the first time that MNCs can complain WTO inconsistent policies to MOFCOM.
Additionally and due to the fact that one of the Vice Chair positions became vacant, we will hold 2014-2015 SH Vice Chair elections. The Legal & Competition Vice Chairs play a crucial role in driving the Working Group, which includes a leadership role in the drafting of the Position Paper, communicating key messages to Chinese and European government authorities and steering Working Group meetings. The desired characteristics of a Vice Chair are a senior industry representative with relevant industry expertise and government contacts who has the time and willingness to support the Working Group. Previous participation in the Working Group is essential. The maximum duration of Vice Chairmanship of a Group is three consecutive years. Candidates are only eligible for Vice Chair position if he/she is physically based in China and it is recommended that the member holds the position in the Chapter where he/she is physically based. Both Corporate and Associate members are eligible to hold Vice Chair positions. For the Legal & Competition Working Group, it is possible to have at most two Vice Chairs in each chapter.

In accordance with European Chamber internal guidelines, another email will be sent to the Working Group prior to the election, with the biographies and motivation letters of all candidates attached. The election must be conducted in person at the Working Group meeting after each candidate has had the opportunity to give a short speech on why they would like to run for election. One company has one vote. The duration of the term for both Chairs and Vice Chairs is one year. All elected Chairpersons must sign the attached Code of Conduct, following election.
