‘Anti-Monopoly’ was without a doubt one of the hottest topics in China in 2014. As one of the State Council’s three departments undertaking the enforcement of the Anti-Monopoly Law, the National Development and Reform Commission (NDRC) had a busy year tackling price-related,anti-trust behaviour.
While many questioned the focus of these investigations, perceiving biasagainst foreign enterprises, the NDRC has maintained that they have been based purely on fair competition regardless of nationality and ownership: they reinforced this with a‘transparency drive’by publishing all decisions online. In 2015, the European Chamber will continue its active role inproviding a bridge between industry and Chinese law enforcement agencies, to help promote mutual understanding and communication in the interests of a healthy anti-monopoly framework for all businesses operating in China.
We will kick off the New Year with an anti-monopoly dialogue with the NDRC on 22nd January, and facilitate training on the Anti-Monopoly Law, provided by Deputy Director General Li Qing from the NDRC’s Price Supervision and Anti-Monopoly Bureau and Mr. Wan Jiang from the Bureau's Legal Affairs Division. Mr. Wan will provide a presentation on the AML enforcement procedures, drawing examples from past investigations, followed by a Q&A session with DDG Li.

The NDRC Price Supervision and Anti-Monopoly Bureau is responsible for drafting administrative laws and regulations for price supervision and inspection; guiding and organising price supervision and inspection; handling activities and cases related to commodity pricing, service pricing and fee collection involving violation of price-related laws by central government agencies; handling price monopoly activities; and reconsideration of cases and appeals concerning the punishment of price violations.
