On 19th January, 2015, the PRC Ministry of Commerce release the Foreign Investment Law (Draft) for public comments. If the law is adopted, China’s current foreign investment regime, which has been in place since 1979, will be replaced by a new system based on the principle of national treatment, a national security review system and extensive entity reporting obligations.
The European Chamber has invited Simmons & Simmons partner Alan Xu to give a presentation on the Draft on 12th March. Alan was invited by the Chinese Government participate in the drafting of legislation for China’s national security review system in 2010 (now Chapter 4 of the Draft), and later in the law itself. He also helped the European Chamber to prepare comments on the Draft. As such, his first-hand accounts and in-depth knowledge of the discussions about the drafting of the law should be of value to counsels interested in the foreign investment landscape in China.
