The Ministry of Human Resources and Social Security (MOHRSS) issued the finalized regulation relating to labour dispatch (namely, the Interim Provisions on Labour Dispatch) on 24 January 2014. The Labour Dispatch Regulations takes effect from 1 March 2014. With the transitional provisions, enterprises could handle the issue within two years after the effective date of the Interim Provision ( i.e., before 1 March 2016)
As early as 2014, it has aroused heated discussion on the relevant details of the new regulation:
- Definitions of ‘temporary’, ‘auxiliary’ and ‘replaceable’;
- Maximum percentage of labour dispatch staff: the number of dispatched staff should not exceed 10% of the total number of the workforce;
- Restrictions on the returning labour dispatch staff back to staffing agency ;
- Social insurance rules related to the labour dispatch;
Only 6 months to the deadline, which is on 1 March 2016, do you face following questions?
- How does the Labour Authority inspect host entity?
- How to implement the penalty for non-compliance?
- How about the practices of other enterprises with a large number of workforce, such as the Suning, the ICBC?
- Or, on the unsettled matters in the regulations, such as “equal pay for equal work” principle, “the fixed term of contract”, etc.
