Chinese Authorities are increasingly shifting their focus from permitting of industrial facilities to ensuring operational compliance. In the last 12 months, over 30,000 violations were issued under the new Environmental Protection Law, with over 6,500 industrial facilities being ordered to suspend or shutdown operations, resulting in business interruption and supply chain disruption.

On 26 April 2018, the High People’s Court of Guangdong Province, China’s high-tech heartland, issued the Working Guidelines on the Trial of Standard Essential Patent Disputes (For Trial Implementation) 《关于审理标准必要专利纠纷案件的工作指引(试行)》. While these Guidelines are currently legally binding locally, they endorse recognised court practices on SEP-related issues. Thus, they may also shed light on the factors that courts in other parts of China may consider in such cases.
