我国《个人信息保护法》确立了以告知-同意为主要合法性基础的个人信息处理规则。作为支撑上位法告知-同意有关要求落地的重要参考,2023年5月23日,推荐性国家标准GB/T 42574—2023 《信息安全技术 个人信息处理中告知和同意的实施指南》正式发布,并将于2023年12月1日实施。
该标准明确了告知个人信息处理规则、取得个人同意的具体实施方法和步骤,包括单独同意和书面同意的实施,并对APP、云计算、车内、快递物流、互联网金融等13个常见个人信息处理情形给出了细化说明。
值此之际,中国欧盟商会网络安全子工作组及标准与合格评定工作组有幸邀请该标准起草专家(已确认),对标准重点内容及其落地实施进行解读,并与会员企业交流探讨。
