Recently, Beijing Science and Technology Commission and Zhongguancun Science and Technology Park released Zhongguancun Demonstration Zone’s “1+5” financial support policy. Noting that, the European Chamber, in collaboration with the Capital Intellectual Property Services Association, is pleased to invite officials to give an in-depth policy interpterion on the section re ‘strengthening IPR protection, technological standards application’ of Zhongguancun National Independent Innovation Demonstration Zone’s Measures on Optimising the Ecological Environment Supportive Funding for Innovation and Entrepreneurship (Trial).

At the China national level, several legislative and administrative documentations, including the Regulations on the Foreign Investment Law Implementation and the Opinions on Further Stabilizing Foreign Trade and Stabilizing Foreign Investment, stipulate that foreign investment should be encouraged and promoted; the legitimate rights and interests of foreign investment should be protected; and the threshold for foreign-invested R&D centers to enjoy preferential policies should be lowered. Overall, the foreign investment should be encouraged to invest in China to set up R&D centers.

At the Beijing municipal level, there was and absence of specified documentations addressing the establishment and development of foreign-funded R&D centers. Moreover, the boundaries for the identification of foreign-invested R&D centers were relatively blurred. Noting that, Beijing has formulated a special policy to attract foreign investment R&D centers to set up development in Beijing to serve the development of foreign investors in Beijing and promote more open, inclusive, mutually beneficial and shared international scientific and technological cooperation.

在中国国家层面,《中华人民共和国外商投资法实施条例》和《关于进一步做好稳外贸稳外资工作的意见》等文件都明确指出,鼓励和促进外商投资,保护外商投资合法权益,降低外资研发中心享受优惠政策门槛,鼓励外商来华投资设立研发中心。

在北京市层面,之前尚无针对外资研发中心设立和发展的专门文件,对于外资研发中心的认定界限也相对模糊。为此,北京市出台制订吸引外资研发中心在京设立发展专门政策,服务外商在京发展,促进更加开放包容、互惠共享的国际科技合作。

On 23rd February, the European Commission published a proposal for a Directive on Sustainable Corporate Governance. The European Chamber has invited Ms Orsolya Csorba, Counsellor for Competition, Justice and Consumer Policy at the Delegation of the European Union to China to provide a debriefing on the Commission’s proposal. Ms Csorba will provide the debriefing onsite in Beijing on Thursday, 31st March from 10:00AM to 11:00AM. Members wishing to attend online will be provided a Zoom link.

Recent WTO disputes, an ongoing trade war, and significant rates of ongoing intellectual property (IP) infringement in China have amplified concerns about the strength of the country's IP regime. At the same time, across many indicators, China's IP regime is relatively supportive of European businesses. For European firms, this seeming contradiction is difficult to explain to fellow employees and top management in China -- let alone headquarters, clients, and government representatives. And yet, without a convincing explanation offered to these stakeholders, business activities in China may run sub-optimally at a time where competition is fiercer than ever. This working group meeting will seek to both explain and offer some solutions to this conundrum.
