SAFE Circular 21: Further Simplifying Foreign Exchange Controls for Foreign Direct Investment
On 20th June, the European Union Chamber of Commerce invited Mr Zheng Yu, partner at Gide Loyrette Nouel and Ms Tracy Zhang, tax partner at KPMG, to provide expert insight into the implication of State Administration of Foreign Exchange (SAFE) Circular 21 and Circular 59 that further simplify foreign exchange procedures and regulations for foreign direct investment in China.

On the 21st June, the European Chamber met with Commissioner Karel De Gucht.The Commissioner debriefed the representatives of the European Chamber about the EU-China Joint Committee meeting, the current EU trade policy agenda with China and globally and briefly mentioned the solar panels case. The European Chamber debriefed the Commissioners on its current priorities and current lobby priorities. The meeting ended with the European Chamber making two recommendations regarding the definition of private capital used by Chinese authorities and the need of a database tracking Chinese ODI to Europe.

The Regulation of Establishment Foreign Entity or Person Invested Partnership provides that a Foreign Invested Partnership (FIP) is a partnership enterprise established by two or more foreign enterprises or individuals, as well as foreign enterprises or individuals jointly with Chinese natural persons, legal persons or other organizations. Besides the differences in investors’ liabilities, FIP is favored for its lower taxes and because it does not require MOFCOM’s approval.
