Uncertainty in the global economic outlook is giving rise to disputes worldwide as the bargaining power of parties’ changes and China is no exception. European Union Chamber of Commerce in China is pleased to present two distinguished arbitration specialists, Jie Wang and Patrick Norton, who will describe to members some of the latest developments in resolving disputes in China.
Jie Wang joined the CIETAC (China International Economic and Trade Arbitration Commission) as the head of the International Case Department in 1996 and became a panel-arbitrator of the CIETAC in 1999. Since then, she has chaired the CIETAC arbitral tribunals or served as sole arbitrator in about 100 arbitration cases. Most of her cases involved disputes of intellectual property, joint ventures and international sale of goods.
She will introduce CIETAC’s new Arbitration Rules, which seek to create a flexible and business friendly approach to dispute resolution.
Patrick Norton was formerly the Managing Partner of a leading foreign law firm in Beijing. He is now based in Washington DC with Steptoe & Johnson LLP, where he handles disputes for companies based throughout Asia. He also sits as an arbitrator. He will discuss:
* How to structure dispute resolution clauses: which arbitral institutions to use; onshore versus offshore arbitration. In particular he will focus on how approaches to dispute resolution in China involving foreigners have changed.
* Mediation versus arbitration or both? What is the best approach to resolving a dispute between a foreign and a Chinese party in China? Are there other alternatives?
* Enforcement of arbitration awards; what can a foreign party do if counterparty with assets in China does not honor an award?
