IPR Working Group Meeting

Note: This meeting will replace the January 18th meeting announced in the December IPR Newsletter (i.e. there will not be a meeting on January 18th)

Dear IPR Working Group Member,
The European Chamber is pleased to invite you to the next IPR Working Group (WG) Meeting which will be held on February 10, 2011 from 10am-11:30am in the European Chamber's Shanghai and Beijing offices – please note the meeting will start at 10am, so it is kindly advised to arrive before then. Video conference will be set-up between the two offices. This meeting will primarily be aimed at providing feedback to the European Commission for their February 2012 meeting re the IPR Action Plan, which will focus on the cooperation between Customs authorities and other enforcement agencies in China.
The tentative agenda is as follows:
1. Introductions by Paul Ranjard, Chair of the IPR Working Group
2. As requested by the Delegation, provide information and insights on the following:
a. Confirm position on thresholds for transfer of cases for criminal investigation
b. Calculation of the value of certain goods (how is it established by customs and on which basis)?
c. What is the average timeline between customs seizure and transfer to MPS?
d. What is the nature of evidence transferred to MPS (which documents are relevant, e.g. invoices, bill of loading, reports)?
e. What kind of investigation is carried out by Customs prior to transfer to MPS?
f. Provide statistics on transfer of cases by GACC to MPS and on number of cases MPS “accepted” or refused
3. Initial ideas on changes for distant future revisions to the Copyright Law
4. AOB and dates for next meetings/activities
