We are pleased to announce that the European Chamber PRD Chapter is setting up a new Legal & Taxation Working Group (WG).
In the first meeting, common issues will be discussed before launching officially the WG with a Chairperson. The kickoff meeting for this WG will be held on Monday, the 21st of May at the office of Rouse & Co. International at 5pm.
In the Legal & Taxation WG the participants will be experts on the field of laws and regulations. The WG will meet regularly and discuss new laws and issues the European Companies face in China.
In the kickoff meeting, we will discuss the content of the Position Paper related to legal and taxation issues and how it is used to address our message to Chinese authorities. The Legal & Taxation WG gives the opportunity to include your concerns in this publication.
Furthermore, we will discuss your common issues. As it is a brainstorming session, this kickoff is crucial for the future of the WG.

Tina Molz welcomed all participants and informed the group about the aim of the Working Groups and the Position Paper. It was stressed out that this meeting would have a big impact on the future meetings: definition of the future topics and decision on the further way of the WG will be conducted. Afterwards all the participants introduced themselves.
2. Roundtable discussion about future topics
In the beginning of the roundtable discussion, the participants stressed out the benefit that the European Chamber members should profit from this Working Group. The exchange of experiences and the discussion about laws and regulations should help to highlight them from different points of view.
To summarize the participants came to the following conclusions:
- The WG will meet bi-monthly and the first regular meeting of the Working Group will be in the third week of June to discuss the Position Paper.
- The future topics will be:
Corporate Income Tax & its implementation IP and its enforcement (consistency of authorities, interpretation of laws and regulations, transparency) VAT & Customs (Transactional Taxes, Double Tax Treaty) Double Tax Avoidance (DTA) Agreement Labor Contract Law (as soon as the third draft is adopted) Because of new regulations the business between Hong Kong and the mainland will change in future; how is this change implemented in Guangdong? Bankruptcy law Factory Transfer (very specific to South China)
It was mentioned that there is the possibility to make joint sessions with the existing HR Working Group of the Pearl River Delta Chapter. This was especially said for the new employment contract law.
Furthermore the possibility to include legal departments of member companies has been discussed. But after checking it was found out that these Legal Departments are in Beijing or Shanghai.
