As one of the major annual events of the European Union Chamber of Commerce in China, the Cybersecurity Conference has been held for six consecutive years since 2016, becoming a well-recognised industry event on cybersecurity and data compliance for foreign companies operating in Chinese market, due to its focus on legislative developments and interpretation of relevant regulations.

A number of cybersecurity-related regulations have been published and implemented over the past year, including the Measures for Cross-border Data Transfer Security Assessments, Measures for the Standard Contract for the Outbound Transfer of Personal Information, the Personal Information Protection Certification Regime and the Interim Measures on the Administration of Generative Artificial Intelligence Services. Of particular note, in August 2023, the State Council released its Opinions on Further Optimising the Foreign Investment Environment and Increasing Efforts to Attract Foreign Investment, and in September, the Cyberspace Administration of China issued a draft Provisions on Regulating and Promoting Cross-border Data Transfers, which aims to adjust the current regulatory framework for outbound data flow, sending positive signals on encouraging foreign investment and promoting cross-border data transfer in a safe and orderly manner.

The "Convention Abolishing the Requirement of Legalization for Foreign Public Documents," also known as the Apostille Convention, became effective in China on November 7, 2023. This widely applicable convention, with the highest number of contracting members under the Hague Conference on Private International Law, aims to streamline the cross-border circulation of public documents. This change significantly reduces both the time and economic costs associated with document processing for both Chinese and foreign citizens and businesses, thereby facilitating international trade and personal exchanges.

The government affairs (GA) work of enterprises is often compared to “building a rainbow bridge of communication and cooperation between the government and enterprises”. In fact, for the GA departments of multi-national companies (MNCs), the “external communication” with Chinese government agencies only accounts for half of their daily work, while the other half of GA work, the “internal communication” within the company, is the basic guarantee and core power to determine the effectiveness of “external communication” work, and the full understanding and cooperation of the enterprises’ senior managements and the heads of various business departments is of great significance for promoting the smooth development of GA and giving full play to the value of GA function.
