On December 11th, 2001, China entered World Trade Organisation (WTO) and China market was opening since then. Artificial intelligence, especially generative AI, is gradually becoming a new engine for economic development, leading the trend of global technological innovation while reshaping various industries.

China has already published various policies, regulations and standards relating to AI. Most recently, in early July, Ministry of Industry and Information Technology (MIIT), Office of the Central Cyberspace Affairs Commission (CAC), National Development and Reform Commission (NDRC), and Standardization Administration of China (SAC) jointly issued the National Comprehensive Standardization System for Artificial Intelligence Industry (2024 Edition). MIIT also announced the establishment plan of the AI Standardization Technical Committee, the secretariat of which will be located at the China Academy of Information and Communication Technology, to expedite the formulation of AI standards in support of industry development.

A year ago, on July 13, 2023, a number of Chinese departments jointly issued China's first regulatory document on generative AI, the Interim Measures for the Administration of Generative AI Services. On the upcoming first anniversary of the release of the Interim Measures, the European Union Chamber of Commerce in China is honoured to invite well-known experts, lawyers, consulting institutions and representatives from industries to discuss the current situation, challenges and future trends of the AI industry in depth and conduct a comprehensive analysis of AI development in light of recent developments. 2023年12月29日，全国人大公布了新修订的《公司法》，自2024年7月1日起施行。新修订的《公司法》对公司董事、监事、高级管理人员的责任进一步明确和细化，其中第188条成为追究董监高履职不当责任的重要法律依据。本次讲座的目的是以法律视角解读董监高责任。第一部分是通过对董监高EHS领域法律责任的分析，帮助董监高合规履职，避免被索赔的风险，第二部分是通过董监高责任保险的重点条款分析，帮助企业合理运用董监高责任保险，分散公司以及董事、监事、高级管理人员的被索赔风险。
On 29 December 2023, the National People’s Congress announced the newly revised Company Law which will take effect from 1 July 2024. The revised Company Law further clarifies and elaborates on the responsibilities of company directors, supervisors, and senior executives, of which the Article 188 has become an important legal basis for holding them accountable for improper performance of their duties. The purpose of this seminar is to interpret senior executive’s lability from legal perspective. The first part will analyze the legal responsibilities of directors, supervisors, and senior executives in the EHS field, help them fulfill their compliance obligations while avoid potential claims. The second part will interpret the important provisions of director and officer liability insurance, guide enterprise to effectively use appropriate insurance instruments to mitigate potential risk of claim against both the enterprise and its directors, supervisors, and senior executives.
